A case that challenges President-elect Barack Obama's name on the 2008 election ballot citing questions over his citizenship has been scheduled for a "conference" at the U.S. Supreme Court.

Conferences are private meetings of the justices at which they review cases and decide which ones to accept for formal review. This case is set for a conference Dec. 5, just 10 days before the Electoral College is scheduled to meet to make formal the election of Obama as the nation's next president.

The Supreme Court's website listed the date for the case brought by Leo C. Donofrio against Nina Wells, the secretary of state in New Jersey, over not only Obama's name on the 2008 election ballot but those of two others, Sen. John McCain and Roger Calero.

The case, unsuccessful at the state level, had been submitted to Justice David Souter, who rejected it. The case then was resubmitted to Justice Clarence Thomas. The next line on

That's not how it works.

The ELECTORAL COLLEGE is still the final say. The Democrat electors can cast votes for ANY Democrat who qualified to run for POTUS.

They could as easily vote for Hilary Clinton as Bill Richardson or anyone else who ran as a democrat.

As far as dual citizenship and running for POTUS would it not disqualify him anyway? I do not know since I do have difficulties interpreting the law, but I found this on another site:

This, in and of itself, may arguably disqualify him under Article II as the whole point of the “Natural Born Citizen” requirement is the avoidance of divided allegiances.

I've tried to find anything that would explain this to me, but unfortunately I can't! Is there a lawyer on here?

Are you suggesting that maybe his mother was, shall we say, casually loose with how many sexual partners she was enjoying at any given time and that the actual Father could have been one of many? Its hard to believe that there is any other name than BHO,Sr. on the Birth Certificate. It is easy to believe that the Birth Certificate CLEARLY PROVES THAT BARACK HUSSEIN OBAMA,Jr. IS NOT A NATURAL BORN U.S. CITIZEN!! ZERO IS A FRAUD AND A CON-ARTIST!


I have seen it suggested that Frank Marshall Davis may have been his real father. Frank was Obama’s Grandfather’s best friend and was a known Sexual Predator and liked young White girls.

I’ve seen a copy of his birth certificate on the web that has been verified as genuine and authentic by Department of Health officials of the state of Hawaii.

He was born in the city of Honolulu, in the county of Honolulu, on the Island of Oahu in the state of Hawaii at 7:24 P.M. on August 4, 1961.

No, it would not affect his natural born status.

Plus, if his father is indeed BHO,Sr., he would have been born a subject of Great Britain, again dual loyalties, and it wouldn't matter where he was born. Basis of Donofrio's case, right?

As long as Obama was born in the US, it wouldn't matter who is father or mother was in terms of being natural born is concerned. Overseas, the rules are different and it would depend on whether his mother was indeed married to BHO, Sr.

My statement which means nothing I will state anyway! I do believe that he probably came back using the Indonesian passport and registered in his colleges as a foreign student thus giving him easy access to funds and priority admittance. This is why his college transcripts are also sealed.

Lots of unproven assmumptions here. First, Obama would have to apply for a student visa from Indonesia, i.e., be physcially there. I seriously doubt that Obama would apply to Occidential as a foreign student with an American mother and having attended high school in Hawaii.

The department of health said no such thing. What they stated was they in fact held his original document - they never verified the website document to be authentic. Find the site of where they stated that. You may have seen that in headlines on various web sites but they also inserted exactly what the Department of Health stated. They did not verify his birth certificate that was posted on his site.

Announcements in the newspaper mean nothing. His mother registered him on August 8, 1961 in Hawaii as a birth. Where he was born is a mystery. By those records the announcement in the newspaper dated August 12, 1961 came from the department as a birth - period. Again, no proof!

BUT INDONESIA DOES NOT; he would have had to renounce any other citizenship to get their passport!

First, when did he get an Indonesian passport? And having an Indonesian passport does not affect his American citizenship unless his formally renounces his American citizenship before a consular offical. If Indonesia wants to take away his citizenship, that is between the Indonesians and Obama. It has nothing to do with his US citizenship.

Yes, I agree since I can't support any of this since everything is sealed. But, it has been proven that he travelled to Indonesia in 1981 before heading out to Pakistan. If Pakistan did not allow American Citizens to enter their country at that time would it not have been beneficial for him to re-apply for an Indonesian passport? Again, I can not back up any of this. It is all just questions that I would love to know the answer to. I guess I hate the fact that our President is completely unknown to all of us. For such a high commission we should know a lot more.

FYI: A parent cannot renounce a minor's citizenship or have it taken away.

I am not sure this is true, despite the law.

Berg makes reference to the Hague Convention of 1930. Although treaties are not supposed to override the Constitution, I am not sure what the situation is with respect to statutory law. I suspect the treaty comes first as long as it is not in violation of the Constitution.

Berg argues that by the Hague convention the US, as a party, has agreed to respect other countries laws regarding citizenship. In particular, if another country prohibits dual citizenship and you become a citizen thereof, then you necessarily become a non-citizen of the US.

I don't understand where he gets this from the Hague convention, but maybe I am missing something.

There is almost no difference between a Hawaii long form Certification of Live Birth and a Hawaii short form Certification of Live Birth.
Here’s an example of the long form and the additional information on it is insignificant.

Anyone requesting a copy of their birth certificate in Hawaii is issued the short form. Nobody gets the long form issued to them and as it says on every short form Certification of Live Birth: “This copy serves as prima facie evidence of the fact of birth in any court proceeding.”
Obama’s says that he was born in Honolulu on August 4, 1961 at 7:24 P.M. and the date that it was filed by the state registrar was August 8, 1961.

There were no prohibitions for Americans entering Pakistan in 1981. There were State Department travel advisories warning amcits about terrorism and other violence. I know that as a fact having travelled to Pakistan frequently during that period, i.e., 1979 to 1981 as part of my official duties in the State Department relating to working with the Pakistani government on the rebuilding of our embassy and apartments, which were burned down in 1979 when a mob attacked it on the rumor that the US was involved in the takeover of the Kaba in Mecca. There were plenty of private amcits in Pakistan.

Thank you for the clarification, that information I never heard. I do know that I need to learn more and I appreciate you helping me along. :) I thought it was a Marshall law of some sort and it was prohibited.

This just simply isn't so. We have millions of Americans who hold dual nationality in this country, including holding passports from those countries, e.g., Israel, Ireland, etc.

"A U.S. citizen may acquire foreign citizenship by marriage, or a person naturalized as a U.S. citizen may not lose the citizenship of the country of birth.U.S. law does not mention dual nationality or require a person to choose one citizenship or another. Also, a person who is automatically granted another citizenship does not risk losing U.S. citizenship. In order to lose U.S. citizenship, the law requires that the person must apply for the foreign citizenship voluntarily, by free choice, and with the intention to give up U.S. citizenship."

I know who Mr. Obama is-a constructed character, a Manchurean Candidate who’s entire life is either a lie or a preparation to run for office, then higher office, etc., until reaching the top. I have nothing but contempt for him.

Nonetheless, when criticizing him we need to stick to the facts. Our best weapon is our credibility - once we lose it, we’re just a bunch of unhappy, partisan wack-jobs. We need to be able to calmly and accurately say to those around us “see, I told you Mr. Obama would do X, or conduct business in X manner - and now he’s gone and done it. Maybe you’ll think about voting him out next time.”
