The California Supreme Court voted 6 to 1 on Wednesday to review legal challenges to Proposition 8, the voter initiative that restored a ban on same-sex marriage, but refused to permit gay weddings to resume pending a final decision.
The court may hold a hearing on the lawsuits as early as March, a timetable that scholars said was swift considering the complexity and importance of the legal issues.
The court's action, taken during a closed conference, suggested that the court wants to resolve all of the legal issues surrounding Proposition 8, including the fate of existing gay marriages, in a single ruling.
It also indicated that at least one of the court's seven members, Justice Carlos R. Moreno, may be leaning in favor of overturning the measure. Moreno, who joined the state high court's 4-3 ruling in May to strike down a state ban on same-sex marriage, was the only justice to support granting a stay of the proposition.
In a move that puzzled some legal analysts, Justice Joyce L. Kennard, a generally reliable supporter of gay rights, voted to deny review of the Proposition 8 challenges. The court gave no indication of her reasons but said she was willing to hear a separate case on the validity of existing gay marriages.

I’d love to be the fly on the wall during the great “deliberations” that will take place in the Mexifornia Supreme Court. First the “Justices” will consider whether the Proposition passed by a sufficient margin to cause massive public outcry when they overturn it. Then, they’ll consider the significance of the fact that 70 percent of African Americans voted for the Proposition, and whether that could have a negative impact on the Democrats. But, at the end of the day, the gay and gay friendly majority on the Court will decide that they just don’t want to live in a State where “gay marriage” isn’t the norm. Then they’ll find the one (liberal) “Republican appointee” on the Court, and brow-beat him/her into drafting the schmaltzy “opinion” striking Prop 8 down.
Liberals are always eager to give the people what they want. Unless they don’t agree with what the people want. Then they’re eager to give the people what they think the people should have.
It’s sorta like the dog who always follows his master around with utter loyalty - as long as the master’s going right where the dog wants to go, anyway.
If the California Supreme Court wants to go down this road, we’ll Rose Bird the bitches who betray the will of the California public as soon as they come up for re-election.
So bring it on judges. Do what you will. And don’t be surprised when we do what we will.
The public has spoken on this issue twice.
Maybe the good citizens of CA should put a proposition on next year’s ballot to eliminate the CA Supreme Court.
That should give them and the gaystapo plenty of time to contort logic and sheer common sense to the point that they stand on their heads. Common reason is an extremely durable, bullet-proof animal, and it takes quite a bit of monkeying and dismantling to make it say something that it doesn't. This shouldn't take more than a week in a normal universe to come to the obvious conclusion.
Still, I'm quite surprised that the Court didn't stay the implementation of the Amendment. I didn't think they would give the Prop 8 supporters the same consideration that they gave the gaystapo.
What a bunch of crap. Puzzled? Maybe, just maybe, there are SOME judges who actually want to apply the law as written. Maybe, just maybe, there are SOME judges who know that when the People have spoken, and they have approved a Constitutional Amendment, then that's the law of the land, DESPITE the judges own personal opinions on the topic. Maybe, just maybe, SOME judges actually do their jobs, at least SOME of the time...
But, at the end of the day, the gay and gay friendly majority on the Court will decide that they just dont want to live in a State where gay marriage isnt the normDo they really want to kill their careers that badly? Fortunately, if they want to stay in the Court, they have plenty of case law to justify upholding Prop. 8.
