I think that we need a brute force search in order to find the applicable info. I have been researching the Hague Convention of 1930 on Nationality ... haven’t found anything yet.
They have monkeyed around so much with the Immigration and Naturalization Act of 1952 so much in the last 56 years (changing length of U.S. residency after a certain age ... 14, 15, 16, etc.).
Anyway, it seems to me that they FORGOT one thing ... the disclaimer!
Per SEC. 357. [8 U.S.C. 1489]:
“Nothing in this title shall be applied in contravention of the provisions of any treaty or convention to which the United States is a party and which has been ratified by the Senate before December 25, 1952: Provided, however, That no woman who was a national of the United States shall be deemed to have lost her nationality solely by reason of her marriage to an alien on or after September 22, 1922, or to an alien racially ineligible to citizenship on or after March 3, 1931, or, in the case of a woman who was a United States citizen at birth, through residence abroad following such marriage, notwithstanding the provisions of any existing treaty or convention.”
Berg cites the Hague Convention of 1930 as precedent. If the Senate ratified it AND NEVER repealed it, then the laws pertaining to the Hague Convention of 1930 STILL apply.
I think that is where Berg gets the 10 years U.S. residency (5 after the age of 14) in order for Stanley Ann Dunham to register Obama as a natural born citizen.
Can you get this to Donofrio? I don’t have his contact info.

The Immigration Reform and Control Act of 1986 (IRCA) mandates employment eligibility verification for ALL employees in the U.S. Including federal employment.
POTUS is a federal job AND it has a natural born citizenship requirement. A check of the BC would satisfy the requirements.

UPDATE: 11:43 AM CST (Nov.13.2008) Mr. Danny Bickell, stay clerk of the US Supreme Court, has finally corrected the Docket for US Supreme Court Case No. 08A407, Donofrio v. Wells, to reflect that this case has come to the US Supreme Court directly from a final order denying emergency relief by the New Jersey Supreme Court. Having this case properly docketed is a major procedural necessity to the case having proper standing to be decided in the US Supreme Court. Great News! I will continue to send my letter to Justice Thomas as planned and hope others do the same. Don’t just stop sending your letter because we have some good news. We need to let Justice Thomas know that we appreciate him giving this case his attention and look forward to his decision so that we know our Constitution is being upheld!

You were the one who first brought up the 14th Amendment here, not me. I merely pointed out that it had nothing to with foreign-born vs natural-born. (And there aren’t any 142-year-old children of freed slaves running for President last I checked. Good nitpick, though.)
You are correct in pointing out that 14A created something called a “US citizen” as opposed to state citizen. (That leads to a whole other rabbit hole regarding corporate personhood, united States vs United States of America etc etc.)
Now, since you did repeatedly and LOUDLY bring it up, though, let’s look at what it says. It says that US citizens are either “born... in the United States” or “naturalized in the United States.”
Kenya is not and never was in the United States.
Colon, Panama is not and never was in the United States.
Nicaragua is not and never was in the United States.
Any “US citizens” who were born in those places are therefore naturalized citizens. Not natural-born.
As noted in the Blackstone commentary you excerpted vis-a-vis children of govt employees, this naturalization took place when the child returned to the territory of the U.S. under a kind of postliminium, which in McCain’s case would have been when he crossed into the Canal Zone from Colon, Panama with his mother a few days after birth. Since Barry0’s American parents Davis & Dunham were presumably not govt employees, his naturalization would be subject to statutory law rather than common law. (If Dunham and/or Davis were secretly CIA, Barry0 would have been naturalized postliminium when he and Stanley Ann crossed back into Washington State from Vancouver after the flights back from Kenya in mid/late August 1961.)
