I wish I knew. How exactly would someone enforce the “natural born” requirement if no one has the right to force the candidates to provide proof of birth? Legally, who has standing to ensure requirements for political office are complied with?

According to the ruling, Berg’s case failed to prove he’d be harmed if his claims in the suit were correct. We’re talking about a very fine point of Constitutional law (who has standing & can prove harm, the public or the candidates who should rightfully have been the party’s nominee?) There are a few other cases chasing this same issue. SCOTUS may wait until one of those other cases have a ruling, so they can claim they had to take it, because the issue was “ripe”. SCOTUS generally prefers to take on the cases that have opposing rulings out of the Appellate Courts.

The law firm is democratic connected and where Michele and Barack once worked. Possibly no conflict but pehaps needs to be investigated. This guy had clerked for the Judge.

This is exactly what the Judge ruled in the McCain case. Only the judge did go the extra step and ruled that McCain was qualified after McCain gave the court the paperwork it was looking for. Judge Surrick just punted.

Seems as though McCain would have standing to question this, but it would be political suicide for him to file a lawsuit at this time.

It seems to me that since he is a Sanator in the state of Illinois, anyone in that state would have standing to ask the question and expect a document that proves that he is a U.S. citizen. I don’t think you have to be born a U.S. citizen to be a Senator, by you do have to be a citizen. Why can’t someone in Illinios file the same suit?

Obama never turned in any paperwork.

He has never turned in any to anyone.

He Ran UNOPPOSED for Senator for Illinois! There was no one to FORCE the issue!

How did Obama get his American passport? While I realize that a passport only means he is a citizen, and I am sure he is, it does not mean he is a natural-born citizen. Nevertheless, one needs some sort of birth certificate to get a passport, doesn’t one?

This stuff must be on file. Obama does not wish to share it, but I am sure it’s not because he is hiding a lack of proper citizenship.

Rather, it may list something else on there he feels would not be palatable. That seems kind of stupid, as anything on there happened when he was incapable of responsibility. Even if his father is a different man, or his religion was Islam, none of that was his fault or doing.

I know. Its all based on what are mostly Tax cases, rulings based on Precedence. Surrick does say that his court lacks Jurisdiction to decide the matter, and so by matter of law, he had to dismiss it.

That is the preamble (aka introduction) of the Constitution, it may have judicial weight but I cannot think of any decisions that were ever based on it.

Nor can do I know of any cases for which the preamble was a basis for argument.

Hun, I am desperately afraid you are right. It will make ALL of the race riots look like a Teletubbies birthday party. because its going to involve people outright attacking others because they have a McCain bumper sticker, or sign in their yards. This time it isn't about race, its about Ideology and Socialism has no issues at all with eliminating decent through death.
