Judge rejects Montco lawyer's bid to have Obama removed from ballot [Berg's lawsuit]

A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.

In a 34-page memorandum and opinion, the judge said Berg's allegations of harm were "too vague and too attenuated" to confer standing on him or any other voters.
Surrick ruled that Berg's attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were "frivolous and not worthy of discussion."

If McCain wins, we need to prosecute ALL government officials who willfully ignored corruption in the voting process. They need to be removed from office and jailed. None of this Bush “playing nice” nonsense where we overlook it because we won and we are above all that.
It is not a matter of being gracious winners vs. being vindictive. It is a matter of preserving the integrity of the ballot box and the judicial system.
I have no problem with someone holding a different point of view. I have a big problem with someone who lies and cheats.

Berg was once in the office of the AG of PA. Surely he's networked. OTOH he's a democrat, looking at what “the machine did to Joe/plummer who wants to deal with that.
Berg's been hired by a few Kooks, which IMO tarnished his reputation.
But, as someone here mentioned lots of lawyers represent killers, thieves etc and that doesn't make them one.
I hope he makes his documentation public on line. IMO if it survives the Pajama Media, he can then take it further.

Yeah, I agree with you. He would most certainly have understood he didn’t have standing and he is just one weird dude. Being weird doesn’t disqualify you, of course, but he’s quite unusual.
I would indeed hope he makes his documentation public. He certainly has no reason not to.

Most of the time I predict a McCain landslide. In my occasional pessimistic moments, I’m nervous. It’s hard to know how big an effect the dead voters and foreign voters will have this year.

I’d Berg to ask the judge what materials he used to decide why it was “patently untrue” and what caused him to believe the material he used was correct?

I can understand the judge deciding that Berg did not have standing but patently untrue? It was the DNC or Obama that said the claims were "patently false". The judge agreed that Berg didn't have standing, not that the claims were patently false, but the reporter phrased it in such a way as to make it sound like the judge used the words "patently false".

While your answer helps to clarify who has standing in a lawsuit, IMO it missed the point of my query. Some office or gov’t entity has to be RESPONSIBLE to ensure that these requirements are met.
When I applied for my SS retirement benefits, I was required to bring my birth certificate. This was to prove my age. The clerk that I presented the certificate to took a photocopy of it. Now, I'm sure that clerk could not determine the validity of that document (especially since it was from a different state) and that the photocopy was sent into the vast inner workings of the SS system where the bureaucracy checked its authenticity. It's what they do. It is their job. The SS laws give them the responsibility and the authority to verify my bona fides.
Who or what government entity has the responsibility and the authority to verify Obama’s bona fides pursuant to the Constitution?,

Ah. I gotcha. I misunderstood. Sorry about that.
you know, one would think you are correct but, rather bluntly, I’ll be damned if I know who it is or even if it exists. It’s never been an issue and, prior to now, seems so basic and easy that I would suppose there is no oversight. If there is, it is likely on the state level when the parties petition to put their candidates names on the ballots. I would be astounded if there is anything nationally on the Fed level. Probably all state stuff and probably pretty pro forma, ie.e just make sure the correct boxes are checked.

So IOW, back to when BHO ran for the US House of Representatives, US Senate, and possibly even the IL State Senate (I don’t know the requirements in IL) it was just assumed that he met all the citizenship requirements.
