New 4473's - Important Changes for Stripped Receivers

The new ATF 4473's are arriving at gun dealers around the country. The new yellow forms are supposed to be used no later than November 15.

There is an important difference between the new forms and the old forms. The old forms only differentiated between "Long Gun" and "Handgun". The new forms have another category "Other" which covers stripped receivers. From the instructions that go with the new form:

If a frame or receiver can only be made into a long gun (rifle or shotgun) it is still a frame or receiver not a handgun or long gun. However they are still firearms by definition and subject to the same GCA limitations as any other firearm. See section 921(a)(3)(b).

18 USC section 922(b)(1) makes it unlawful for a licensee to sell any firearm other than a shotgun of rifle to any person under 21.

Since a frame or receiver for a firearm to include one that can only be made into a long gun, is a "firearm other than a shotgun or a rifle" it cannot be transferred to anyone under the age of 21.

Also note that multiple sale forms are not required for frames or receivers of any firearms or pistol grip firearms, since they are not "pistols or revolvers" under section 923(g)(3)(a).

Note the section bolded above. In the past dealers have transfered stripped receivers to people age 18-20 because stripped receivers aren't handguns. ATF has now changed that.

There were some machinist types who were making 80% receivers, I think that is one of the points behind the new regulation(?).

The new 4473 has nothing to do with 80% receivers as they are not firearms. No transfer through an FFL is required to buy, sell, or ship them.

I was under the impression that one declared the intended build as handgun or longgun at the time of purchase. Wouldn’t that preclude 18-21’s from buying for handguns? They’d be in a world of hurt if they committed fraud on the 4473 and then built a handgun from a longgun receiver. I’m guessing that this is just an incremental step at reducing the number of guns sold, but it doesn’t make much sense unless someone at ATF has a leftist bent and is noticing an uptick in AR lowers being sold to 18-21’s.

OK, you're ignorant! Just kidding. They are and have always been considered "firearms". Their further classification has been in effect been changed from "not a handgun" to "not a rifle", meaning 18-20 year olds can no longer purchase them.

Slightly off topic, but does anyone have any comments on Stag AR lowers?

Even more off topic, but encouraging... I heard Mrs. kitchen say to a customer yesterday, "... if he doesn't try to take all our guns..." She's qualified with handguns and a fair rifle shot, but basically could care less about shooting. Looks like this election is bringing a few things to the surface.

You could, but it's not required. Also, it's not illegal for an 18-20 year old to possess or build a handgun, buy it privately, or accept it as a gift. An FFL just legally can't transfer one to him. Unreal, eh? Legally an 18-20 year old can purchase a full-auto ma deuce .50-cal rifle (if he's lucky enough to have the $$$) but not a .22-cal revolver, from a dealer.

New 4473 for anyone interested.

Thanks for the link. I wonder why it took the geniuses this long to put “yes” and “no” boxes after the questions. You could get writer’s cramp filling out a 4473.

Is a Krinkov considered a pistol or short barreled rifle?

I was gonna build an AK on a receiver I built sometime ago but may have to build a Krinkov instead.

The Krinkov is an SBR, unless you permanently mount a faux silencer or other barrel extension on it.
