Phil J. Berg files amended complaint in Berg v. Obama

Phil J. Berg filed an amended complaint today in Berg v. Obama. The amended complaint adds the Pennsylvania Department of State, the Secretary of the Commonwealth Pedro A. Cortes (in his official capacity), the U. S. Sentate Committee on Rules and Administration, and Senator Diane Feinstein (in her official capacity as chairman) for their failure to exercise due diligence with respect to Barack Obama's contitutional qualifications to be elected and serve as President of The United States, and for his inclusion on the ballot in Pennsylvania as a candidate for President of the United States.

The amended complaint also bolsters the standing argument and adds additional relevent facts.

Essentially, the argument is this:

* Senator Obama could put this whole issue to rest by providing an official "vault copy" birth certificate. * Senator Obama has chosen not to do so. * The defendants (other than Obama) have a responsibility to protect the integrity of the electoral system by properly vetting the qualifications of candidates, which they have failed to perform. * Mr. Berg, other Americans, and our system of government are damaged by this failure. * Senator Obama, who has collected $425,000,000 in campaign contributions, has perpetrated a fraud.

Following are some of the factual statements made in the amended complaint (The complete complaint is attached below):

36. Obama is a representative of the Democratic People. However, Obama must meet the Qualifications specified for the United States Office of the President, which he must be a “natural born” citizen. Additionally, Obama must be at least a “naturalized” citizen to hold his Office of U.S. Senator for Illinois. Unfortunately, Obama is not a “natural born” citizen, nor is he a “naturalized” citizen. Just to name one of the problems, Obama lost U.S. citizenship when .. mother married Indonesian citizen..

I used to think that this was maybe just a red herring. I thought the Obama campaign was just letting the right wing spin their wheels over this and waste a lot of time and effort, thus diverting them from investigating real and more serious issues.

I now have serious doubts about his citizenship. I think there is a good chance he was born in Kenya, and/or lost his citizenship while living in Indonesia.

Isn’t it interesting that while all this controversy is happening, Jerome Corsi is being detained in Kenya? Maybe he is getting too close to finding the COLB which shows that BHO was born there.

My only question is : Why didn’t Hillary expose this before he got the nomination?

Look close, and it says his father was African. Back in the 60’s it would have said NEGRO.

Sure I'll explain it, you have pictures of a possibly forged certificate of live birth in the hands of people that by their own admission CANNOT prove the authenticity of the document.

Factcheck noted that they were not experts on document forgery and could not prove that it was legitimate, they offered it as possible proof subjected to no examination other then their handling of the hard copy.

“No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States. “

Not to be dense, but is that the clause? Wouldn’t “natural born” include born to a citizen on foreign shores, as opposed to becoming one later in life (i.e. Schwarzeneggar)?

But isn’t this academic? O’s mother was an American citizen; doesn’t that make O a citizen, wherever he was born?

If he was born overseas to an American parent and a non-American parent, I believe that he was entitled to be registered as a United States citizen, but he was not automatically a citizen. (In Mr. Obama's case, if he was indeed born overseas, I strongly suspect that no Consular Report of Birth Abroad was ever filed.)

For instance, back in the 1970s and 1980s, there was a tremendous outcry about children of American soldiers left in Vietnam. The U.S. government eventually created in 1987 a program so that those children could get a visa to come here called The Amerasian (or American) Homecoming Act, but they were not granted citizenship. Back in the early 2000s, there was some move to actually let them become citizens (see here, for instance), but I don't believe that it went anywhere. (Of course, once they had a permanent immigrant visa, they were also eligible to undergo naturalization like other folks, and I believe that many or most did so.)

Well this particular court may decide it doesn’t want the heat and there-fore will void the arguement, but it doesn’t mean Berg doesn’t have standing. Barak is going to be his HIS president as well as mine...I would say that should be standing enough. Berg may have better served his cause if he had brought in a petition of several hundred thousand names and made it a class action event...I would have signed that petition!

Just FYI - the laws on the books at the time of Obama’s birth were not the same as the laws now (i.e. one parent being a citizen gives automatic citizenship no matter where born, or birth on American soil gave automatic citizenship (anchor babies)). Again, these laws have changed PARTICULARLY when dealing with births in Hawaii as they had just recently achieved statehood.

The reason Obama’s Hawaiian birth also becomes a factor in this argument is because even if he WAS born in Hawaii - according to the laws on the books at that time - there are questions on whether Ann Stanley’s age and length of residency in Hawaii itself may have made Obama ineligible for automatic citizenship.

Now, I’m not sure where that argument went - as far as I don’t remember if it was completely debunked or not, but it’s one reason why I’m glad Berg filed this case. There are SO many details, and so many very intricate legal questions that to figure all of this out given the changes in laws - and indeed the laws of various nations coming into play - it kind of precludes a lot of people from being able to get to the bottom of this.

I’ve read a LOT about this over the last few months, but I still don’t feel any semblance of authority on the intricacies of this case. I just wanted to mention something that was brought up earlier regarding BibChr’s question.
