SAN FRANCISCO (AP) -- A federal judge has thrown out a lawsuit seeking to remove John McCain from the California ballot because he was born in the Panama Canal Zone.
U.S. District Judge William Alsup ruled late Tuesday that the law at the time of McCain's birth automatically granted citizenship to offspring of U.S. citizens.

Personally, if I were McCain, I’d offer him a debate slot - or a few town halls? This of course, provided that McCain’s lawyers, and Barr’s lawyers think it would be worth it to pursue - I imagine it would be expensive. Someone would probably have to pony up the lawyer’s fees, too. But, I think there would be willing donors in both the GOP camps, and the LP camp to fund this...
All, JMHO. To Barr and the Libertarians it would be worth it for the exposure, IMHO. For McCain - well, obviously if it looks as if there’s a real chance to get this to go through then a debate slot, or a town hall wouldn’t really be a problem. I think he’s got enough support that it wouldn’t hurt him. I don’t think Barr can pull anywhere near the sort of numbers away from McCain as he would from the liberal side of the fence. Nader? not as sure about him, but the same deal — debate slot, or a town hall or something...
Of course, this is all just my $.02 again. Others with more wisdom might disagree! LOL

Another thing that might interest the Libertarians might be some administration positions — there are some brilliant minds in the LP, and if a McCain administration would set some of them to work on the economic side of things I don’t see much the GOP could complain about. There are also other things the Libertarians can work with the GOP on in some of the stronger LP states - like Colorado for instance (at least it used to be the case) - when I was part of the LP some of my friends helped get some good gun legislation blocked/some passed, etc... Libertarians are also staunch supporters of the Constitution, and could help cut the budget, and reform the tax code while we’re they’re at it! LOL Just the type of help the Republicans seem to need lately — a return to SMALLER government, where at all possible, as soon as possible...
Anyway, that was just another thought that occurred to me. If my ideas would work at ALL, I hope those who have the power to do something read this and make it happen!
We really can’t afford to let Obama assume the Presidency and the more doubt the better, IMHO. Although where there is this much smoke there is bound to be a least a SMALL fire, and I could probably name more than a few “Big Fires” when it comes to Obama, personally. It really shouldn’t be this hard to render a truly horrid candidate’s prospects equally as horrid!
The lawsuit proceeds to make Obama produce proof that he was born in Hawaii, that he was never an Indonesian Citizen (because if he was he is NOT an American citizen because Indonesia does NOT allow dual citizenship) etc.
A useful idea from a post I made about the lawsuit against Obama and that is to make the state YOU reside in demand proof that Obama is a United States citizen. It’s become pretty obvious that they cannot prove that he is a citizen THEREFORE any reasonble person would assume he is NOT but Americans are no longer reasonable in most cases, we trust our incompetent news media to do our due diligence for us:

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States
I respectfully request that the laws of the U.S. Constitution be enforced. Furthermore, please demand that the Democratic Presidential Nominee Senator Barrack Hussein Obama be required to provide (1) a certified copy of the vault Certificate of Birth; (2) a certified copy of the Oath of Allegiance he would have had to take between the ages of 18-21 to regain his U.S. citizenship after leaving Indonesia; and (3) verify that he registered in the selective service (he would have had to do this within six (6) months of turning eighteen (18).
Before Senator Obama is named on a (YOUR STATE) state ballot for the office of President, the foregoing documents must be produced. Unless Sen. Obama produces evidence to the contrary, I believe he:
Is not a natural-born citizen; and/or
Lost his citizenship when he was adopted in Indonesia; and/or
Has dual loyalties because of his citizenship with Kenya and Indonesia.
Numerous questions raised about Obamas background have no satisfactory answers:
Where was Obama born? Hawaii; an island off of Hawaii; Kenya; Canada?
School records list Obama as a citizen of Indonesia. Was he a citizen of Kenya, Indonesia and/or Canada?
Explanation of the names he has used: Barack Obama, Barry Soetoro, Barry Obama, Barack Dunham, & Barry Dunham.
Illinois Bar Application Obama fails to acknowledge use of names other than Barack Hussein Obama,
As Attorney Generals of the U.S. and (YOUR STATE), Secretary of State of (YOUR STATE), and(USE IF YOU SEND TO YOUR GOVERNOR) Governor of (your state) , I request that you investigate the possible forgery of a Hawaii Certification of Live Birth and require Sen. Obama to answer whether he was ever a citizen of Indonesia and further require him to submit all documentation that led up to him being a U.S. citizen. Senator Obama has refused and/or failed to provide proof of his birth as a natural born U.S. citizen. A falsified birth certificate has circulated the Internet and has been proven by experts to be a forgery. Additionally, a lawsuit has been filed against Sen. Obama, Berg v. Obama, Civil Action No. 08-cv-4083 regarding his qualifications to become President of the U.S.
As a natural citizen of the U.S. and a dedicated American patriot, I am adamant for the security of our nation that we choose our elected officials as required in our federal and state constitutions and laws.

Obama and McCain: Citizenship And Eligibility—Legal Issues
Like it or not, if Obama was born in Kenya, Canada, Venesuela, or on board a ship outside the territorial waters of the US, Obama would not be a "Natural born citizen." His US citizenship was imputed to him, not at birth but when he becane an adult, by virtue of his mom being a US citizen.
Yes, Obama is now a US citizen., but NO, he is not natural born if he was born outside the US.
However the judge you are ultimately looking for on this question is the Supreme Court--ought to be an appeal to the 9th Cir. Ct. App. next.
That's a big if, considering all of the evidence points to Obama being born in Hawaii.
And yet Congress, in 1790, passed a law that made it clear that the children of American citizens born abroad qualified as natural born citizens. In 1790, some of the people who were involved in writing the Constitution were still in Congress. So that seems to show that the natural born citizen means someone who is a citizen at birth, rather than naturalization, regardless of where they are actually born.
The only distinctions in American law regarding citizenship are between a citizen at birth and a naturalized citizen- there is no other category of citizen.
No, you can't. The US has no problem with dual citizenship. The only way you might lose American citizenship in a dual citizenship case is if you actively sought the second citizenship in an effort to renounce American citizenship.
Whether or not the other country recognizes dual citizenship is not relevant.

Thanks for the ping. I’ve been saying all along that the baton needs to pass to the republicans on this lawsuit. McCain should file it now, no expedited discovery unless he falls way behind in the polls.
He won’t file. Grassroots is the only hope to fix this mess. And we have no money.
