Republicans Lack Heart! (File Cease & Desist for 'Barracuda' Song)

Ann and Nancy Wilson are p*ssed at the Republican Party and have fired off a cease and desist letter to the McCain/Palin campaign.

Specifically, the Heart women are upset that the GOP has used their classic "Barracuda" as a theme song for Sarah Palin. TMZ obtained a statement from Heart's rep, who says "The Republican campaign did not ask for permission to use the song, nor would they have been granted that permission."

The statement goes on: "We have asked the Republican campaign publicly not to use our music. We hope our wishes will be honored."

Ann Dustin Wilson (born June 19, 1950 in San Diego, California) is the lead singer and flute player of Heart.

Dam. She's older than I am. Better start thinking about some old age income girls before you have to play the retirement home circuit.

If the song has fallen into the arena of “public domain” or if the RNC or McCain/Palin campaigns subscribe to ASCAP or BMC(?), they don’t have to have permission.

Public domain songs are those whose copyright of 7 years has expired and may be freely used by anyone.

ASCAP and BMC(? I can’t remember if it is BMC or BMA), subscribers pay royalties to the artists during the time that the copyright is active. As long as the copyright is active or renewed, the artist(s) or the publisher can control who can use their music under which circumstances.

Even so, she’s the VP nominee and he’s the P nominee. He’ll soon tire of being continually compared to a mere VP, and he’ll lash out at somebody because of it.

That's a good point. Gretchen's a cool woman. She would likely show respect for Heart and stay out of it.

I saw Heart and Cheap Trick together years ago (free ticket a friend won on the radio.) They were pretty good. Cheap Trick blew em off the stage, though. I just wanted to hear Heart cover Zeppelin. They did "Rock and Roll".

As I suggested last night on another thread, perhaps Heart should consider renaming the song "Barry-Cuda". Another FReeper followed with an even better suggestion: "Barry-Could'a"!

If the ASCAP fees are paid BY THE VENUE, then there is no copyright infringement. Heart is complaining about lack of PERMISSION, not license.

There is a BIG difference.

The Republicans could do a parody of the song and get around it.

I am sure that the McCain campaign is paying the property amount of ASCAP royalties each time that they play the song.

Public domain songs are those whose copyright of 7 years has expired and may be freely used by anyone.

Song copywrites depend on when it was published. Music pubished before 1978 has a 95 year copyright. Music published after 1978 has a copyright of the life of the oldest surviving author plus 70 years. Anything published before 1923 in in the public domain.

Barracuda is all about the guitar hook and the one word lyrical hook “Barracuda.” The rest is gibberish. As for rock lyrics almost always being that way? Maybe. I think there are plenty of examples of meaningful, well crafted rock lyrics. This just ain’t one of them.

Great - I have tickets to see these doofueses, along with Cheap Trick and Journey, Sunday night.

Saw the show a few weeks back. Cheap Trick was horrible. Heart was OK, and Journey was awesome. Pay close attention to their drummer, Dean Castronovo. He actually played ambidextrous within the same song, and he really makes that double kick drum kit rock.

Too bad. I was a big fan. I interviewed Nancy Wilson back in the ‘80s for my college paper. She was nice. Very cute.

A very small person as well, which made her sister look even larger.

Sure there are, but the vast majority is indeed mediocre to embarassing when forced to stand alone without the music. As I said though, it is RARELY the lyrics that sell the song. With the proper power chord structure, rhythm and syncopation, rock groups could be singing about the ring in their toilet bowl and it would sell.

I used to read a lot of rock criticism until I got tired of having to digest analysis regarding the song’s “message”. I, like the vast majority of rock fans, am in it for the musicianship. Too, I can appreciate a superior vocal performance, I just don’t usually care to pay attention to the lyrics.
