LOL - no kidding. Oh, to be a fly on the wall...

Actually, one of the most historic things about the opinion, I think, is the outright rancor between the justices.

Haven’t read the dissent, yet, but I bet Stevens calls Scalia some names.

I found this unsettling: “NEW: Poll finds 67 percent of Americans say Constitution grants right to own gun.”

I would have been in the "false" category on that poll. As Disambiguator notes, it's not the Constitution that grants rights.

"Shall not be questioned" is in the PA Constitution. PA law, however, unquestionably infringes.

Gee, and I thought I was a precisian for terms! The Constitution is law, no?

now that the 2A is firmly established as an enumerated, personal right, any attempts to collect fees, require exams, etc should be treated no differently than voting rights ie poll taxes, qualification exams, etc have all consistently been struck down.

Could be fun to see Justice Breyer's words used against him.... He noted, in his Crawford v. Marion County Election Bd. (.PDF file) dissent:

And some may find the costs associated with these documents unduly burdensome(up to $12 for a copy of a birth certificate; up to $100 for a passport). By way of comparison, this Court previously found unconstitutionally burdensome a poll tax of $1.50 (less than $10 today, inflation-adjusted).

Footnote 27, page 56 - Scalia dismisses rational basis.

However, he dismissed citing footnotes earlier in the opinion.

How machavellian.

Am I the only one bothered by the fact that it was only a 5-4 vote. A precious freedom like the second amendment passed by just one vote. Unreal. Thanks to President Bush for two excellent Justices who voted the freedom way on this. Somehow I don’t think Sandy Baby O’Connor would have voted the right way on this.

Watch, they will soon make insurance mandatory for gun owners, and to my mind if it's mandatory it's a tax! Or some kindred form of govt theft.

Thanks for the ping. 5/9 of the supreme court reaffirmed a little piece of the constitution. 4/9 of the court need to be impeached.

I haven't done more than skim any of it (that's for tonight - 150+ pages). It'd be kind of funny if Stevens was the DU member of the Court, and further demonstrated his irrationality (more than in his dissent, that is) by calling Scalia a bunch of names.

Thank goodness! My brother taught me that a locked up gun is no use in an emergency.

His wife benefited from that when a druggie smashed in her living room window to gain access to the house while she was alone. She grabbed a shotgun and yelled. "I have a gun! Get out of my house!"

He did.

It is interesting to speculate about what might have happened if the 4/9 that can't comprehend simple words and phrases had, instead, been 5/9. I can easily imagine some of them suddenly succumbing to instanteous fatal cases of lead poisoning. I'd NEVER advocate or do any such thing, of course, but stranger things have happened over time and in many, many places. I wonder if such thoughts crossed the mind of Mr. Justice Kennedy as he was considering this case.

Believe me, I meant no insult, no matter what the tone. I'm just quite discouraged at this opinion and the general drift to socialism in this country.

I find that you have a point - see last para page 52, first para 53.

Which point? And which page(s), the page number of/on the opinion itself or the page number assigned by the .pdf file reader? They don't coincide.

...and if they did, I wonder if the Founders were smiling somewhere, pleased in the knowledge that this 27-word addition to the Constitution had quietly done its job of saving the Republic without any bloodshed.
