McCain: Guantanamo Ruling One of the ‘Worst Decisions’ in History

John McCain said Friday that the Supreme Court ruling on Guantanamo Bay detainees is “one of the worst decisions in the history of this country.” The presumptive GOP nominee said the decision, a 5-4 ruling Thursday that determined Guantanamo detainees have the right to seek release in civilian courts, would lead to a wave of frivolous challenges. “We are now going to have the courts flooded with so-called … habeas corpus suits against the government, whether it be about the diet, whether it be about the reading material. And we are going to be bollixed up in a way that is terribly unfortunate because we need to go ahead and adjudicate these cases,” he said at a town hall meeting in New Jersey. McCain said he has worked hard to ensure the U.S. military does not torture prisoners but that the detainees at Guantanamo are still “enemy combatants.” “These are people who are not citizens. They do not and never have been given the rights that citizens in this country have,” he said. “Now, my friends, there are some bad people down there. There are some bad people.” Barack Obama released a statement Thursday saying the Supreme Court decision “ensures that we can protect our nation and bring terrorists to justice while also protecting our core values.” “The Court’s decision is a rejection of the Bush administration’s attempt to create a legal black hole at Guantanamo - yet another failed policy supported by John McCain,” he said. “This is an important step toward re-establishing our credibility as a nation committed to the rule of law and rejecting a false choice between fighting terrorism and respecting habeas corpus.”

No, I did not say that. We will not leave Iraq regardless of whether Obama supports it or not. And he has already backed off of his "immediate retreat from Iraq" position. He has also backed off of his "meet without preconditions" position as well. Your problem is that you think he will be making the decisions if he's the President. Which he won't because that dishonorable POS McCain will likely win.

Disagree with me if you want but stop twisting my words.

Yes it is. They were hanged after a military commision found them guilty, all within the U.S.

No they didn’t. They were tried by a military commision and hanged. They never had access to the federal courts.

Yes you did, you claimed that we will remain in Iraq even if Obama wins. This contradicts both his spoken words and his voting record, which would have had us withdrawn months ago. Now you are apparently saying that we will still remain in Iraq if Obama win, because McCain will likely win, which doesn’t even make any sense. Look at your statement:

If Obama wins we (the U.S.) will stay in Iraq whether Obama likes it or not. But McCain will likely win. Two separate statements. I didn't think they needed to be spelled out with bullet points.

You are as stupid as your looser of a candidate.

The Constitution grants the right of the Writ. The judge does not have to issue release. As in the case of POWs in the US which had access to federal courts which sent the trials back to the military commission. Every person detained on US Territory has the right to go to federal court and file a Writ of Habeas Corpus. Read the citation I sent you. You can read?

The good thing about you when it comes to election day you will have supported a looser or will regret it anyhow. Supporting McCain is loose loose.

If that were true, I’d be spending hours and hours compiling lists of links with clipped, out of context videos attacking McCain, running around thread after thread casting personal attacks against McCain and his supporters, and attempting to portray Obama as someone who wants to win in Iraq, all the while claiming that I don’t care who wins in the general election.

Speaking of history, what’s Obama’s voting history as it relates to Iraq?

This is a 180 degree turn from his consistant stance of retreat and defeat. He has repeatedly voted against funding the troops, sponsored legislation that would have had them withdrawn months ago, and he could easliy veto any funding for the troops if he becomes POTUS. He has repeatedly blamed the violence in Iraq on U.S. troop presense, and has said he will meet with Amanidijad without preconditions. And now you expect conservatives to believe he will suddenly support our strategy in Iraq, if he becomes President?

I repeat you are stupid.

The recent SCOTUS decision (READ IT) gave detainees in GITMO the right to file a Writ for Habeas Corpus because they ruled Camp Delta was de facto US Territory. If the the detainees in GITMO would have been transferred to the US as McCain wanted there would not have had to be the ruling because they would have the right to file a Writ of Habeas Corpus. The POWs in the United States most certainly had the right to file in federal court but the judge sends it back. If they would have had a sympothetic judge they could have been freed.

Your argument is that people can be detained inside the United States without the right to go to Federal court and demand a release. The judge does not have to grant it but he could. If the detainees (before the last decision) were kept in GITMO they did not have the right even to petition.

If you read this you will discover that the point the majority made was that GITMO is de facto US Territory. The ruling was not that the detainees get special priviledges the ruling is they get treated as if they were CONUS.

Well the Dems have nominated a lib which reflects the parties orientation. The GOP nominated a Lib also. That is funny.

Yes, and the GOP has made a great mistake by throwing the conservative Republicans under the bus and expecting them to vote for someone that does not represent them. They are turning away from McCain in droves.

Go to the FR front page and read the founders statement to find out what FR is all about before declaring your flawed (an anti McCain site) interpretation.

There's the problem. McCain isn't a Pro-conservative candidate, he is the anti Obama candidate.
