Is Obama's candidacy even constitutional?

Bloggers are raising questions about Illinois Sen. Barack Obama's qualifications to be U.S. president, because of the secrecy over his birth certificate and the requirement presidents be "natural-born" U.S. citizens.

Jim Geraghty, reporting on the Campaign Spot, cited the "unlikely" but still circulating rumor that Obama was born not within the United States, but elsewhere, possibly Kenya.

It is incumbent upon Obama to make these facts public, since he MAY be constitutionally forbidden to run for the presidency.

Here's a cynical view for you:

In my best Clinton fashion I'm playing semantic games here, but the Constitution only says the eligibility to be president, it says nothing about running for president.

I suppose someone with questionable eligibility could run, build up a massive following, then find out he's ineligible, but the mass population forces the Supreme Court to decline to rule on eligibility, citing that if he loses it's a moot point -- come back if he wins. Of course, if he wins, it would be impossible to refuse to seat him.

On the other hand, another candidate with almost the same massive following could challenge the eligibility at a nominating convention and argue that it's in everyone's best interest to avoid the problem in the first place by nominating someone else.

It’s not like someone couldn’t ‘come up’ with one!

I say keep O Bambi talking. (Some Clinton supporters are noticing that he’s picking up her platform and are really angry about it. But as you know, since he’s won the primary this is the traditional ‘move to the center’ we’ve all come to expect.)

Ding, ding, ding. We have a winner.

Only thing I could think of why he would not want his birth certificate to be seen. Rather silly reason though, as a baby can't be held responsible for the religion of his parents.

I’d bet that it says he is white............. and so do the other docutments.

That’s a stretch. I don’t think that law applied to someone who was born, raised in, and never resided permanently outside the United States, even if she were only 18. Heck if that’s the case then millions of Americans who are 4th or 5th generation, born to mothers under 21, aren’t “natural born” citizens.

Just for grins do you have a similar list on how one can lose their US citizenship, like for instance using a foreign passport and not reaffirming their citizenship.

OK, just took off my tin-foil hat after downing a few Diet-Cokes and came up with this one....

Hillary is the VP nomination.
Nobama gets elected POTUS but ‘someone’ challenges the authenticity of his presidency based on whether he is legally allowed (citizenship).
Goes to Supreme Court
He gets ruled inelligle and has to resin
Hillary becomes president by default

OK... now back to my cubicle.

False. While he would be an american citizen, he would not be a natural born citizen if born in Kenya.

Wrong. Even if born in Kenya to an American mother he would be a natural born citizen.

See below:

The 14th Amendment defines citizenship this way: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

But even this does not get specific enough. As usual, the Constitution provides the framework for the law, but it is the law that fills in the gaps.

Anyone falling into these categories is considered natural-born, and is eligible to run for President or Vice President. These provisions allow the children of military families to be considered natural-born, for example.

But really, let's keep wasting bandwidth on Larry Sinclair, the non-existent "whitey" tape, pictures of Obama riding a bike & this issue.

And then we can all be surprised in November when Obama wins because people were focused on stupid, non-existent issues instead of issues that might actually affect his candidacy.

Even if born in Kenya, he qualifites because of his American-citizen mother.

That possibly may not be true. There is an obscure law that states his mother has to have been 21 at the time when Obama was born if he was born in Kenya. His mother appears to have been 18 at the time.
