Not at all convincing.

First, if McCain should win and keep his word and nominate justices in the mold of Roberts and Alito, who thinks that Pat Leahy and Teddy Kennedy will allow them out of the judiciary committee?

And if Stevens or Ginsburg left the bench, there is NO WAY IN HELL that the Dem. Senate will allow any nominee that would result in a conservative majority.

And, as has been said, he’d probably “reach across the aisle” to Leahy and his great friend Teddy Kennedy and agree upon some nominee (as Republicans did for Ginsburg) that would infuriate the conservative base.

And if a Dem. becomes president, the Republican senators should fight any far left nominee, and use the filibuster (as the Dems. have many times) to defeat them.

People are greatly exaggerating the the advantage of having McCain in the WH re: SCOTUS. No further move to a more conservative court until Republicans regain the Senate. It’s mostly defense until that happens.

2. McCain-Fiengold (Assault on Free Speech and Pro-Life groups and Gun-rights groups)
3. McCain-Kennedy (Amnesty for criminal Illegal Aliens)
4. McCain-Lieberman (50 cents a gallon tax)
5. Total support for global warming scam, including carbo cap and trade system.
6. Support for embryonic stem cell research (Murder of unborn babies).
7. Leaked top-secret information concerning CIA prisons in Europe
8. Wants to close Gitmo and give Terrorists access to our legal system.
9. F grade from Gun-Owners of America.
10. C- grade from NRA.
11. 60% score from American Conservative Union in 2006
12. Wants to bail out sub-prime losers (many of which are either illegal aliens or lied on thier applications) with US tax money.
13. Voted against President Bush’s tax cuts (called them tax-cuts for the rich)
14. Flirted with the idea of crossing over to the Dems in 2004.

Hey, we’re rolling the dice. We can expect Obama or Clinton to be true to their convictions when it comes time to choose Supreme Court justices.

We can’t be sure what McCain will do, if he has any principles, if he would betray them, based on what rationale. We can be sure he would betray our principles in a flat minute, that we know. But it is that mathematical uncertainty that is the whole justification to vote for McCain. We know what a Dem will do. We really don’t know what McCain will do. So there is that sliver of a chance things will be better with McCain choosing the Supremes.

A sliver. And this being 2008, I guess thats what we have to settle for.
