Will Rush Limbaugh Be Indicted for Voter Fraud?

As Ohio election officials investigate illegal crossover voting in the 2008 primary, questions arise on Rush Limbaugh's role.

Limbaugh, the nation's top-rated talk radio host, was urging Republicans in Texas and Ohio to skip their party's primary on March 4 and instead cast a vote for Hillary Clinton in order to prolong the fight between her and Barack Obama.

What Limbaugh encouraged Republican voters to do in Ohio was a fifth-degree felony in that state, punishable with a $2,500 fine and six to 12 months in jail.

On Thursday, March 20, the Cleveland Plain Dealer reported that the "Cuyahoga County Board of Election has launched an investigation that could lead to criminal charges against voters who maliciously switched parties for the March 4 presidential primary."

In 2008, 2.22 million Ohioans voted in the Democratic primary, compared to 1.27 million in 2000, according to unofficial results released by Brunner's office. In contrast, 1.01 million Ohioans voted in the 2008 Republican primary, compared to nearly 918,000 people in 2004.

Michael Slater of Project Vote, a nonpartisan group that designs voter registration drives for low-income people, said GOP meddling in the Ohio Democratic Primary was a clear-cut example of fraudulent voting, which is how Republicans have defined the issue in recent years, as GOP advocates have urged state legislatures and Congress to adopt anti-fraud measures such as tougher voter ID laws.

"Here we have a real instance of spurring people on to engage in illegal election activities with a real intent to affect the outcome," Slater said. "That is voter fraud. People were encouraged to break the law. They had to declare allegiance to a political party and sign a document under penalty of perjury. Intent is what matters in voter fraud."

My better perspective has more to do with Rush than whether McCain will win the election. You can’t shift the dynamics of your argument, although that seems to be the way a lot of people argue here.

I don’t know that McCain will win, but right now, repeat, right now, I would rather be McCain than Hillary or Obama.

There will be a fight in Denver, ‘cause Hillary isn’t going away quietly...and if you assume she will prevail, then you have a better crystal ball than I.

And, further, if she does take the nomination you can’t possibly comprehend the anger that blacks will have following their perception that Hillary stole the nomination from Barack, and they will do that, believe me.

OTOH, Obama has the nomination now, in the eyes of many people, especially blacks. If he is denied, look out.

In short, I don’t know what will happen, but at this moment in time, I can, at least, have a fairly reasoned supposition.

You’re the one who needs to learn that freedom isn’t free. Men will not fight under command of manly women and effeminate men who hate their own fellow Americans and conspire with communist and Islamist enemies against our nation. I won’t vote for such leaders, either.

We see the choices in candidates presented by elite constituents—all three candidates being essentially alike and serving those constituents. Those constituents need to learn lessons. We should look forward to a dollar equal to the yuan. It will be good for us. I only pray that our cities won’t be nuked as a result of our leadership playing for those constituents against our defense.

I’ll make it more clear for readers of this discussion. If we take care of business in Iran now, oil will be much higher today and for a short while. If we don’t take care of business in Iran now, Iran will build a large nuclear arsenal before most of us will be aware of it. Oil will go much higher then and stay much higher. Some people only live for where they can go today.

Constituents—”citizens of the world”—who depend on cheap freight fuel and a high dollar are against needed military action. They are also in favor of anti-family social programs that keep too many wives and mothers working outside their homes. They’ve divided and conquered the American family to keep other Americans cheaper and more subservient. Those constituents are running the political show here now. I’m not going to humor their political/economic/personal games by supporting any of their puppets.

Except for the fact that:

1) This is a state "crime";

2) Limbaugh did not vote in Ohio, the allege crime that took place;

3) Limbaugh was not in Ohio and therefore not subject to its jurisdiction when the "crime" took place.

If voters are simply switching parties to vote in a different party’s primary, and are doing so according to the rules set up by the parties themselves, they are not breaking any laws, so he couldn’t be indicted for encouraging illegal activity.

First it was the Democrats trying to discern the intent of the voters in Florida in 2000, now they are trying to discern the intent of the registrants before they even vote?

RUSH: The Drive-Bys are fascinated with possible criminal charges in Ohio related to Operation Chaos. They're still investigating whether or not Republican voters lied about their pledge to become Democrats when they went in there and voted in the Ohio primary. Hugh Hewitt, renowned member of the Reagan administration, who has his own blog and talk show in the afternoons from California. He is from Cleveland, and said that if I get indicted in this, if I get charged along with any voters, he's going to defend me; he'll be happy to defend me. He says especially since I'm a Steelers fan, I'm going to need somebody in my camp in Ohio that has Cleveland Brown season tickets, which he does. So I appreciate that support from Hugh Hewitt, as well, ladies and gentlemen, as from you. If any of you people in Ohio end up getting charged -- and I frankly can't see it, fear not, worry not -- Operation Chaos will commence a massive legal defense fund, and we'll defend you. (laughter) This is just too much.
