DURHAM -- In a filing Tuesday in Federal Court, unindicted Duke Lacrosse players are suing Duke University, the City of Durham, Duke University professors, Mike Nifong and the DNA lab involved in the case.
The suit also names doctors and nurses who treated the alleged victim the night she claimed she'd been raped at a party. The players are also suing City Manager Patrick Baker and former Durham Police Chief Stephen Chalmers. As part of the investigation, the unindicted players had to give up DNA samples and were named in the school paper.
In the 404-page lawsuit, the players say that Duke University, the City of Durham and the other defendants were part of a "conspiracy to railroad 47 Duke University students" based on "the transparently false claim of rape, sexual offense, and kidnapping made by a clinically unreliable accuser." Also in the lawsuit, the players say that the accuser's claim was "taken virtually from her lips and fashioned into a weapon in the hands of those who would leverage outrage."

Rae Evans doesn’t see this as a hobby. She’s no soccer mom.
David Evans mother is a very accomplished woman. She is very wired into the Washington, D.C. scene and a very formidable opponent. Of anybody involved in this mess, she is the last one you would want to go up against.
That's right. Even though you didn't hire the strippers and were required to attending this spring break party you should be eternally punished.
perhaps my favorite. I can sooo see this guy signing some letter to be cool/hip despite any evidence. freak.
Bull_hit!
Not a one of them couldn’t have walked away. The only ones on the team with an excuse were the comatose.
Stupid, stupid, stupid.
Cry me a river.
HB-
I know, of course.
Please see post 61.
Actually a number of them walked away. You weren’t aware?
You should do some research before you condemn other sinners.
Fortunately Our Lord will.
Real bright — the ones who walked away have joined together with those who stayed???
And, I didn’t call them sinners. I called them braindead.
And I don’t believe that anyone can be required to come to a social event. If the Army can’t do it, then I know the lacrosse team can’t.
You don't really think that no criminal prosecution could result if a non-suspect witness in a wrongful death suit blurted out that he himself was the killer, do you?
“Not sure I’m on board with this part. Depose as witnesses maybe, but sue? Not unless maybe they falsified evidence or something.”
Prosecutors ALWAYS over-charge...then the charges are generally reduced, as are the number of people sued in the first place. It always starts out as a “fishing expedition.”
It’s actually a pretty smart way to do things, though. Threaten to sue EVERYONE even remotely involved, see who caves first, see who becomes a Witness for the Defense along the way, see who will turn State’s Evidence and then litigate.
(I’m not a lawyer, but I’ve read nearly every crime novel ever written. Ask me anything, LOL!)
Do you consider hiring strippers to be the moral equivalency of law enforcement and University officials conspiring to falsely convict three innocent men of rape?
Before you get so angry you should find out much more about this case.
A number of the young men walked away from the event. They have evidence, telephone and ATM records, that they were many miles away.
The issue here is criminal conduct on the part of Durham officials and now, apparently, on the part of Duke University and its Board of Trustees. Let’s not forget the conduct of the prostitute who had the DNA of NINE different men in her.
If you feel you have to cast stones why don’t you point them in another direction?
I would tell my son:
“Don’t go if there’s a stripper/hooker. It’s not WISE.”
That’s not stone-throwing. That’s just good old fashioned common sense.
What would you tell your son (assuming, of course, that you have one? :>)
Good job!
This group of 88 should be hung!
Hope the Fong is finding that out :)
