Giuliani: Kids of Illegal Immigrants OK

BLUFFTON, S.C. (AP) — Republican White House hopeful Rudy Giuliani said Friday he wouldn't try to change laws that make citizens of children born in the U.S. to illegal immigrants, noting that it's a matter determined by the Constitution.

"That's a very delicate balance that's been arrived at, and I wouldn't change that," Giuliani said in response to a question while campaigning at Sun City Hilton Head, a sprawling retirement community down the South Carolina coast from Charleston.

In Wednesday night's Republican debate, Giuliani and nomination rival Mitt Romney traded accusations of being soft on illegal immigration, and Giuliani took pains to deny that New York was a "sanctuary city" for illegal immigrants during his tenure as mayor.

While New York has never used the designation, it offers protections — allowing illegal immigrants to report crimes, send kids to school or seek medical treatment without fear of being reported — similar to those in cities that label themselves sanctuary cities.

Children born in the U.S. to illegal immigrants already are American citizens, and Giuliani said he would not try to change that.

While it might be difficult, the law obviously needs to be changed on this. No one should be considered an American citizen just because they were born of illegal aliens within our borders.

How widely known is it that Giulianni favors this rubbish, and why is he allowed to run as a Republican?

Big legal business likes slave labor, and big illegal drug cartels like open borders. And with money is the mother’s milk of all things political. Add to that native born Americans bought into birth control and small families, and I would say we are between a rock and a hard place when it comes to really changing the dynamics of this massive problem.

Why Mexican illegals are driving America "cuckoo"

Why doesn't Mexico take care of its own people? Why don't the ultra-wealthy Mexican elites help to pay for the health care and education etc of their own poor? Why do they instead encourage their poor to leave Mexico and invade the United States? Nature provides a parallel that is instructive.

Some species of birds thrive not by carefully rearing their own young, but by pawning that task off on adults of other species. The European Cuckoo, whose distinctive call is immortalized in the sound of the "cuckoo clock," is the bird in which this habit has been most thoroughly studied. Female European Cuckoos lay their eggs only in the nests of other species of birds. A cuckoo egg usually closely mimics the eggs of the host (one of whose eggs is often removed by the cuckoo).

The host may recognize the intruding egg and abandon the nest, or it may incubate and hatch the cuckoo egg. Shortly after hatching, the young European Cuckoo, using a scoop-like depression on its back, instinctively shoves over the edge of the nest any solid object that it contacts. With the disappearance of their eggs and rightful young, the foster parents are free to devote all of their care to the young cuckoo. Frequently this is an awesome task, since the cuckoo chick often grows much larger than the host adults long before it can care for itself. One of the tragicomic scenes in nature is a pair of small foster parents working like Sisyphus to keep up with the voracious appetite of an outsized young cuckoo.

While Giuliani is generally wrong about most social issues, he is standing on firm ground here.

It should be obvious to anyone with a passing familiarity with the US Constitution that we have birthright citizenship.

If you want to end brithright citizenship, you will have to amend the Constitution. No state or federal law that tried to eliminate birthright citizenship would ever pass Constitutional muster in the federal courts - nor should it, because such a law would be blatantly unconstitutional.

And even if you do amend the Constitution, you will not be able to revoke the citizenship of anyone already born in the USA to an illegal alien, because not only our Constitution, but our entire legal system and the common law system from which it emerged, rejects the concept of ex post facto law entirely.

Oh, BS. It's been ignored, that's all. No one has ever adjudicated it, and every attempt to clarify it by legislation has been stymied.

It's the PC default position since the politicians are shaking in their boots about doing their job.

It offends common sense that illegal alien parents are the people who get to determine who the American citizens will be in the future.

Well, let's see.

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.
What does that "and subject to the jurisdiction thereof" mean? It must mean something. Does anyone think that if we were invaded by some foreign army that included females that the 14th amendment framers thought to include the children they dropped here as citizens of the United States? Well, we have been invaded; and we are being invaded. The enemy chooses not to wear uniforms. Should this give their offspring citizenship? No one in his right mind should think so.

There's no new law needed. The whole anchor baby for illegal aliens rule was brought to us via executive policy decades ago and can be undone the same way. Let the illegal apologists sue up to the USSC. Since Giuliani the liberal won't go there we need someone who will. Or maybe a state like Oklahoma can challenge it themselves.

Mine also. Huckabee is taking votes from Thompson and Hunter and helping Rudy.

Birthright citizenship is not to be awarded to illegal aliens. Illegal aliens should not even be in this country and not be eligible to any perks.

Rudy and Huckabee are both weak on national defense, and both would lose in '08.
