KANSAS CITY, Mo. A jury on Friday decided that a woman convicted of killing an expectant mother and cutting her baby from her womb should receive the death penalty.
Jurors deliberated for more than five hours before recommending the sentence for Lisa Montgomery. Prosecutors say a judge will sentence Montgomery, but is obligated to abide by the jury's recommendation.
Montgomery, 39, was convicted Monday of kidnapping and killing Bobbie Jo Stinnett on Dec. 16, 2004, in the victim's home in the northwest Missouri town of Skidmore. She was arrested the next day in Melvern, Kan., where she was showing off the newborn as her own.
...
Showing jurors photos of the bloody crime scene, the prosecution told jurors Thursday that Montgomery deserves to die because of the heinousness of her crime, and because computer evidence including Internet searches on performing Caesareans shows the crime was premeditated.

"Defense attorney Fred Duchardt, who claims sexual abuse during Montgomery's childhood led to mental illness, asked the jury to spare his client's life. He said emotional abuse from her mother and sexual abuse from her stepfather "killed Lisa's soul." "
Oh stop it already!
Just because you had a tough childhood doesn't entitled you to prop up a failing marriage by cutting a baby out of a pregnant woman. There is no "mental illness" going on. She PLANNED this mruder and did it and then pretended it was her own baby to save her lousy marriage. That's not instanity - that's pure EVIL.
Prison for life is too easy of an punishment.
Hell is worse than any prison on this earth.
Like any other sinner, she can takes responsiblity and change her eternity - she earned this. I truly can't imagine the horror this young woman went through as she was being MURDERED.

Thank GOD!
I’m sick and tired of seeing punishment defined DOWN.
This cold, calculating freak EARNED capital punishment.
How dare she HIDE behind this bad childhood stuff. I know others that had “bad childhoods” and they don’t do stuff like THIS. It’s not insanity - it’s pure, SELFISH, evil.

I am sure the victim’s mother’s comment had a lot to do with the penalty:
It looked like she had exploded...there was blood everywhere.
Other testimony indicated that she was ALIVE when the baby was removed.

It is evil what she done, she will not have to suffer the old age aliments. Maybe she is getting off light. I am far from perfect but, I pray my record stays and improves because one worries about the after life and being Judged for all the good things one could have done and failed to do them.

I hope this doesn’t drag on for years - I would hope the child would not have to ever know that this most evil of the evils lives and breathes = much better to have her goneThere is certainly no reason such a person needs to live

I hadn’t thought of that.
I can’t get past the horror.
That little baby needs prayer. Maybe it would be better if they didn’t tell her how her Mom died.

She’s obviously demon possessed. She should get executed ASAP. Forget that “mentally ill” crap. That’s irrelevant. I don’t care if she is or isn’t. Why should the mentally deranged skate on murder charges?

Diminished capacity:
This is one case where the jury saw through this defense. Unfortunately juries don't always do so.
I can remember a number of times when I've read of a defendant's uncanny ability to pull facts together, incorporate them into intricate plans to conduct a crime and then execute that crime. Then their defending attorney made the case that this person wasn't able to understand complex issues.
Here's one such case. Good for the jury. I congratulate them. I am sad and happy at the same time for the victim's family, friends and associates.
The plea for the perps family just leaves me steaming. It's a rediculous request. They are due no more consideration that the family of the victim. In this case as well as others, NONE!
