Death Penalty Case Puts Bush and Texas at Odds Over Mexican's Fate

WASHINGTON — President Bush, who presided over 152 executions as governor of Texas, wants to halt the state's execution of a Mexican national for the brutal killing of two teenage girls.

The case of Jose Ernesto Medellin has become a confusing test of presidential power that the U.S. Supreme Court, which hears the case this week, ultimately will sort out.

The president wants to enforce a decision by the International Court of Justice that found the convictions of Medellin and 50 other Mexican-born prisoners violated their rights to legal help as outlined in the 1963 Vienna Convention.

That is the same court Bush has since said he plans to ignore if it makes similar decisions affecting state criminal laws.

"The president does not agree with the ICJ's interpretation of the Vienna Convention," the administration said in arguments filed with the court. This time, though, the U.S. agreed to abide by the international court's decision because ignoring it would harm American interests abroad, the government said.

It only says he was born in Mexico and came to the U.S. as a child. That’s a very, very different thing

He may be here legally, but At the least, he holds mexican citizenship or he would have no footing with the Mexican consulate.

As a Mexican citizen he hold no loyalty to the US. Even with dual citizenship, any loyalty he might claim is dubious. If he is here legally, then how was he allowed here legally, being such a scum. We used to have requirements on residency. He should not be here and the quickest removal is legal lethal injection.

I didn’t read the FOX story, but I am familiar with the case and the killer is not an American. I don’t know about illegal.

close, but no cigar. No treaty can abrogate or supersede Constitutional law, no matter how ms Ginsburg feels about international law and the supremacy of the communist political system.

And treaties can be legally ignored, abrogated, or unilaterally terminated.

You can’t do that with ease to the Constitution.

We are a nation of laws. Apparently we entered into an agreement at one point that would require us to notifiy foreigners of their right to contact their consulate.

I think that the word that fits best here is “Globalist” and yes, I have come to the conclusion that Bush is a globalist who believes that borders must be not allowed to deter the free trade needs of the 21 century.

And that, along with the relocation of industry at any time, means that labor must have a free hand to travel anywhere that the need presents itself at any time, as well.

Of course, our culture is doomed under this concept, but hey, whats a little thing like the pride and dignity of Western Civilization?

Please read the link at post #17. Why should this one murdering rapist be singled out for special consideration by the President of the United States? Hell Bush isn’t even siding with the American murdering rapists. These girls families deserve justice and Bush needs to stay the hell out of it.

I thought this was a treaty issue or a “failure to notice the embassy” with a foreign national issue.

However submitting to the jusridiction of a FOREIGN court is just plain WRONG.
