Death Penalty Case Puts Bush and Texas at Odds Over Mexican's Fate
Sunday, October 07, 2007
WASHINGTON President Bush, who presided over 152 executions as governor of Texas, wants to halt the state's execution of a Mexican national for the brutal killing of two teenage girls.
The case of Jose Ernesto Medellin has become a confusing test of presidential power that the U.S. Supreme Court, which hears the case this week, ultimately will sort out.
The president wants to enforce a decision by the International Court of Justice that found the convictions of Medellin and 50 other Mexican-born prisoners violated their rights to legal help as outlined in the 1963 Vienna Convention.
That is the same court Bush has since said he plans to ignore if it makes similar decisions affecting state criminal laws.
"The president does not agree with the ICJ's interpretation of the Vienna Convention," the administration said in arguments filed with the court. This time, though, the U.S. agreed to abide by the international court's decision because ignoring it would harm American interests abroad, the government said.

“This is not a nation I want for an ally...”
Not a problem as a few years ago there was a saying in Mexico...”Amigo, Si! Allies, No”
jorge bush....destroying america...one illegal at a time...
what gives with jorge being so far up the culo of mexico???
Ditto!...and would again today given the choices, but...
DON'T MESS WITH TEXAS!!!!! inclludes the POTUS.
Make that four times!
When has he not looked so?
More like? Hell, he IS a one worlder.
The sovereignty of our country means absolutely nothing to this man. He has demonstrated that over and over.
Is there any doubt remaining in anyone’s mind that Bush favors Mexicans over Americans?
Jimmy Carter now has some real competition for the title of most foolish person to ever hold the office of President of the United States.
The next time we wind up with a very stupid stray dog that wonders onto the place needing a home, I have his name picked out, George W.
What President??? Can't be our President. Sounds like Jimmy Carter. Maybe the "pressure" is starting to effect his judgement. Something sure is. Sad.
He may be here legally, but At the least, he holds mexican citizenship or he would have no footing with the Mexican consulate.
As a Mexican citizen he hold no loyalty to the US. Even with dual citizenship, any loyalty he might claim is dubious. If he is here legally, then how was he allowed here legally, being such a scum. We used to have requirements on residency. He should not be here and the quickest removal is legal lethal injection.
Globalist dude strikes again. Since when do international courts have priority over the US courts? Since Jorge was elected! This is sickening!
Hate to admit it but I think you may be correct.
I didn’t read the FOX story, but I am familiar with the case and the killer is not an American. I don’t know about illegal.
>Whether we like it or not, the U.S. signed the Vienna Treaty, and Treaties are equal to the U.S. Constitution under our system of government.
close, but no cigar. No treaty can abrogate or supersede Constitutional law, no matter how ms Ginsburg feels about international law and the supremacy of the communist political system.
And treaties can be legally ignored, abrogated, or unilaterally terminated.
You can’t do that with ease to the Constitution.
We are a nation of laws. Apparently we entered into an agreement at one point that would require us to notifiy foreigners of their right to contact their consulate.
And that, along with the relocation of industry at any time, means that labor must have a free hand to travel anywhere that the need presents itself at any time, as well.
Of course, our culture is doomed under this concept, but hey, whats a little thing like the pride and dignity of Western Civilization?
Everyone of the animals involved in this should be dead by now.
And they would be correct. Texas is going to tell Bush, tell the International Elite to pound sand. Unless, Rick Perry caves.
Oh gads. You just brought up another terrible thought.
That is what Bush is going to do Bush is going to pay off, bribe if you will, Perry to cave.
Get the picture?
yikes!
I thought this was a treaty issue or a “failure to notice the embassy” with a foreign national issue.
However submitting to the jusridiction of a FOREIGN court is just plain WRONG.
I cant believe I voted for this guy. Twice.
Believe it. And you are in a very large group of us all saying the same damned thing. I’m beginning to think he has really lost it.
