NEW YORK (AP) - Dan Rather filed a $70 million lawsuit Wednesday against CBS, alleging that the network made him a "scapegoat" for a discredited story about President Bush's National Guard service.
The 75-year-old Rather, whose final months were clouded by controversy over the report, says the complaint stems from "CBS' intentional mishandling" of the aftermath of the story.
The lawsuit, filed in State Supreme Court in Manhattan, also names CBS President and CEO Leslie Moonves, Viacom Inc. Chairman Sumner Redstone, and former CBS News President Andrew Heyward.
Rather, the former anchorman of the "CBS Evening News," is seeking $20 million in compensatory damages and $50 million in punitive damages.
CBS spokesman Dana McClintock said: "These complaints are old news, and this lawsuit is without merit."
Rather narrated the September 2004 report that claimed President Bush skirted some of his duties during his National Guard service and that a commander felt pressured to sugarcoat Bush's record. He maintains the story was true.
But an independent review for the network determined the story was neither fair nor accurate. CBS fired three news executives and a producer for airing it.
Richard Thornburgh, the former U.S. attorney general who made up the two-man investigative panel with Louis D. Boccardi, the retired chief executive of The Associated Press, said he was unaware of Rather's lawsuit. Reached at his home in Washington, he said only: "Our report speaks for itself."
Rather worked at CBS News starting in 1962, then replaced Walter Cronkite in 1981 as "CBS Evening News" anchorman until signing off on March 9, 2005.

Tryin’ to polish up the ol’ image by casting aspersions elsewhere, ain’t he.
Didn’t he resign or retire? Thats different from getting fired ,so how does CBS owe him any money. CBS should counter sue for disgracing the “integrity” of CBS news.
I hope the court will take the suit, so we can hear all the details of where the phony story came from.
I think Dan will win his lawsuit. His defense team has already produced a memo that will bolster his case. I have procured a copy:
Dear Andrew:
You need to fire Dan Rather right away. I know he’s the smartest most-talented best loved guy in the business, but our right-wing advertisers say he has to go. I know he has a contract and if we fire him then we deserve to get sued and lose, but we have to do it anyway. Let’s just hope Dan won’t stand up for the American people and sue us.

I think that Americans should file a class action suit against Dan Rather for spewing out so much BS on Public Airwaves over several decades.

Stories like this, the fall of OJ and a multitude of other high profile, wealthy folks are living testimony to the fact that their lives are no better than the average person who, by the way, generally finds happiness in places the celebs have forgotten or never knew where to look. Here is a 75 year old man, disgraced, bitter, spiteful and arrogant. I don’t care what he does now or in the future, but for the life of me, why could he not be content to live whatever years he has remaining in the material comfort he has earned and free from the self-imposed torment of having been wrong on so many things. Sad.
I think it's time for us to send him a bill.
Danny boy has apparently forgotten that CBS News still has copies of his personnel files, dating all the way back to when he first joined the network.
