What part of “ All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” doesn’t this writer understand? There are NO distinctions made regarding parentage for the simple reason that citizenship and or priveleges based on parentage were part of the English aristocracy to which the new nation didn’t adhere. Inventing one now with respect to the citizenship of the parents is just sophistry for political ends.

No, it’s not a dumb question. If your parents are, say, foreign diplomats, why should their child born in the US be a citizen of the US, and not a citizen based on their parents’ citizenship ?
Wrong! Parents coming to the United States to have a child, are violating the laws of our nation to be here. It would be silly to argue they or the new child were owed something because they illegaly broke into it. What it would amount to is stealing citizenship.
Whether they "are" in a legal sense may or may not be open to discussion. Whether they SHOULD BE is an entirely different matter. The answer is NO. Under no circumstances should children born of illegals, on US soil, be conferred US citizenship. Period. No discussion.

America’s own naturalization laws from the very beginning never recognized children born to aliens to be anything other than aliens if the parents had not declared their allegiance to the United State - a sure sign that the framers intended children under national law followed the citizenship of their father until he had become naturalized.
I heard on Ingraham’s program today that Dick Durban is going to attach an amendment to the defense bill (troop-funding):
It’s the DREAM act, which was successfully stopped when the ‘comprehensive immigration reform’ bill died. This is basically a huge amnesty masquerading as a small amnesty.
Illegals can get immunity from deportation if they claim they crossed the border before they were 16 years old.
It also opens up in-state tuition for illegals.
A caller overheard a speaker at a La Raza meeting boasting about how Durbin was going to sneak this through and they’d get their ‘comprehensive reform’ amnesty and more in this piecemeal fashion.
Works for me. But then I’m not a crooked judge with expensive tastes willing to violate my oath for a fistful of dollars.
They're trying to get around Section 505 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, which prohibits it.

It is a dumb question, but you still got it wrong:
"The clause [the citizenship clause section 1] specifically excludes all persons born in the United States who are foreigners (not subject to the jurisdiction of the US), aliens, and persons who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons." (Emphasis added). It seems clear that the amendment only applies to American citizens (natural law), regardless of their race - which is exactly what was intended.
Senator Howard clearly intended that the phrase "subject to the jurisdiction" does not apply to anyone other than American citizens.
The he should have written "American citizens." Easy enough.
I'm all for eliminating anchor babies, but let's do it the right way - by amending the Constitution. Pretending that it doesn't say what it says, just because we don't like the result, is a leftist tactic and unworthy of our Republic.

Agreed. If people want to change what the Constitution says there's a perfectly good process called amendments.
