Victim Claims OJ Simpson was "Calling the shots" in Vegas Robbery
AOL News / TMZ.com ^ | 09/14/07 | TMZ Staff

The man who claims he was robbed by O.J. Simpson has just spoken exclusively to TMZ. Alfred Beardsley, a sports memorabilia collector, says Simpson and his posse pretended to be customers who wanted to buy the suit Simpson wore when he was acquitted. Beardsley says they entered the room and two men drew guns.

He said Simpson was calling the shots during the alleged robbery. Earlier today, Simpson told the AP he didn't break into the room, he just took what was his.

But OJ has a well-known cocaine problem and he spends way too much time in a place with no zip-code.

I think that the place OJ has gone to has no return address and his luggage was lost in transit.

Law-abiding citizens who apply for a concealed-carry permit shall be issued such a permit after they complete a required class which includes demonstrating proficiency with the particular handgun.

I think law-abiding citizens are within their rights to carry openly, though there might be jurisdictions that don't agree.

The mere possession of a gun in a hotel room is not a crime.

Drawing a gun, and using its possession to influence the behavior of another person, is another matter entirely.

The presentation of a handgun in such circumstances would typically constitute use of deadly force, or at least the threat to use deadly force. Unless the other people in the room represented a reasonable threat of causing death or great bodily harm to the person who drew the gun, then it is unlikely that the law would justify such drawing of a gun.

The claim that somebody in the room said, "Put the gun down", or some such thing, seems to indicate that a gun was presented by somebody.

There might be a slim chance that stolen property was being recovered. If, while taking possession of that property, the thief attempted to prevent the recovery using force, then those recovering the stolen property would probably be justified in using force in opposition. But the use of deadly force would be quite a ways down the line of possible responses, especially if the size of the people and their numbers indicated little chance that the alleged thief could harm them successfully.

My estimate would be that OJ is in great trouble if a gun was present and was in somebody's hand outside a holster.

To quote O.J., “The answer lies somewhere in the world of Fay Resnick”.

It’s a shame they don’t have our 10-20-Life law. Even if it never left his waistband he would be looking at 10 years hard time, no early parole.

What does a guy do with his time when he gets away with rape or murder? Well obviously if you get away with rape, you can sit back and help your wife campaign for the Presidency. But when you get away with murder, you evidently do not spend your days in the tropics sipping pina coladas. It ain’t easy being found not guilty when you weren’t.

Is that the case? It's gonna be hard to justify a SWAT type operation in such a case without some evidence that the alleged "thief" was going to do OJ and his buddies serious harm.

OJ's actions depend very much on the facts concerning whether the property was stolen, and further, that the person who was in possession knew they were stolen.

Entering the room with guns drawn would seem to constitute assault of the people in the room who would justifiably fear for their lives.

Imagine the mess if the person who OJ accuses of having stolen the items, has a bill of sale and good reason to believe that he is the legal owner of the items. Imagine further, that the person carries a gun.

Such a person would probably be justified in drawing that gun and firing at such a group entering his room with guns drawn. There could have been half a dozen deaths in seconds. Nothing new for OJ, but he might not get off this time.

"I know he seems guilty. But ladies and gentlemen this is Chewbacca. Now think about that for one minute. That does not make sense. Why am I talking about Chewbacca when a man's life is on the line? Why? I'll tell you why. I don't know. It doesn't make sense. If Chewbacca does not make sense you must acquit. Here look at the monkey , look at the silly monkey."

I sure hope you are right- and that Simpson gets the book thrown at him...I still dream of waking up someday to see a news item on Fox: Simpson’s body was found outside the bar with a 9 inch hunting knife sticking out of his chest...there were no fingerprints found on the knife...

I agree with all of the missing persons, but one way I look at it is they are good for ratings, which allow them to cover stuff I am interested in.

Can you provide a source for the claim that video shows that OJs group entered the room with guns drawn? That would certainly be hard to justify.

Did O.J. trace the real killer of Nicole and Ron to this memorabilia show Vegas?

When I saw that post I immediately assumed that the Video is coming from cameras set up at the Hotel in Vegas. It's pretty common knowledge that they have cameras everywhere.

On another vein.. I am interested to know what happened to all the evidence. I heard on Fox that they do not have the guns. Why not? Is this going to turn out to be a comedy of errors before it is finished. Sounds like the Vegas Police may have already bungled this.

If the video doesn’t prove so, then OJ will get free again. If he gets free again, this will show you that lawyers are nothing but pure evil.
