Muslim woman sues sheriff

An Anaheim woman filed a federal lawsuit against the Orange County Sheriff's Department today, claiming her religious rights were violated when deputies forced her to remove her hijab, or head scarf.

Deputies insisted Souhair Khatib, 33, who is Muslim; remove her scarf when she was being booked into a county jail in connection with a probation violation. Islam dictates that women must wear the hijab, which covers a woman's hair and neck, for reasons of modesty.

Khatib was seen by deputies and other men from her mosque without her covering, causing her extreme emotional distress, her lawsuit says.

"For Souhair, to have her head uncovered in public – particularly in the presence of men who are not part of her immediate family – is a serious breach of faith and a deeply humiliating and defiling experience," the suit says.

Khatib, a U.S. citizen who emigrated from Lebanon, along with her husband, Amro Khatib, 32, were in Orange County Superior Court's north courthouse on Nov. 1, 2006, to seek an extension on their community service. The couple had pleaded guilty in June 2006 to a misdemeanor violation of welfare fraud and were sentenced to three years probation and ordered to complete 30 days of community service.

oh, the horror.

The ACLU later filed a public records request with the sheriff's department, seeking a policy statement for religious clothing for the incarcerated, but were told there was no document, said Hector Villagra, director of the ACLU's Orange County office. Villagra said he found that "astonishing" since the U.S. Department of Justice has a policy that allows Muslim women to have three hijabs while in custody.

She wasn’t too modest to commit the crime she was on probation for, nor was she too to violate that probation either.

Would this not violate the "Liberal Creed" of SEPERATION OF CHURCH AND STATE?

The ACLU seems to be searching for that which they protest............

Whenever a Christian wants to do something of a religious nature, the ACLU comes down on the Christian on the basis of Separation of Church and State. But if the police follow standard practices in dealing with a Muslim, the ACLU comes down on the police for religious persecution.

I have trouble understanding the perspective of someone who thinks they can get away with hiding their identity after they’ve been convicted of a crime and after they’ve been re-arrested for violating their probation for said crime.

That’s one interesting mindset.
