IRS loses challenge to prove tax liability(Abolish with The Fair Tax)

The Internal Revenue Service has lost a lawyer's challenge in front of a jury to prove a constitutional foundation for the nation's income tax, and the victorious attorney now is setting his sights higher.

"I think now people are beginning to realize that this has got to be the largest fraud, backed up by intimidation and extortion and by the sheer force of taking peoples property and hard-earned money without any lawful authorization whatsoever," lawyer Tom Cryer told WND just days after a jury in Louisiana acquitted him of two criminal tax counts.

And before you consign him to the legions of "tin foil hat brigades" who argue against paying taxes, and then want payment to explain how to do that, he addresses the issue up front.

"These snake oil peddlers have conned millions of dollars out of many well-intended patriots and left a trail of broken lives in their wake. … These charlatans should be avoided, not only because they will lead you to bankruptcy and prison, but because by association they discredit those who are telling the truth," he said.

The truth, he said, is where he comes in, with the launch of a new Truth Attack website that is intended to build on his victory, and create a coalition of resources to defeat – ultimately – the income tax in the United States

Although the legal citations in the case tend to run the length of paragraphs, Newsbusters explained the substance of his arguments against the federal income tax this way:

It would take too long to relate my particular run ins with the IRS. Suffice to say I got hosed, but ended up cussing out the agent with the point that no entitiy in private industry could get away with the idiocy they use as a work procedure.

I'd have to say NO. The 16th Amendment authorizes Congress to levy a federal income tax regardless of source and without reference to any enumeration or apportionment. Its a direct tax. The only way we'd get rid of the IRS is to repeal the 16th Amendment.

The only way we'd get rid of the IRS is to repeal the 16th Amendment.

You'll be happy to know HJR 16 before the House will repeal the 16th Amendment.

I'm no expert, but I think one of the central points of contention is the definition of "income". Sure, the 16th Amendment allows a tax on income. But if "income" does not mean "wages", then your paycheck cannot be taxed.

This could get interesting. Especially if a dynamic politician wanted to run with the idea of a NRST instead of an income tax.

Something in that article intrigues me

"The IRS considers, in the case of a Wal-Mart wage earner, 100 percent of what he takes in is profit."

BUT, if the government sets the "miminum wage", by that logic, could/should I be able to reduce (from my wage), the government-mandated mimimum wage? After all, if the government has set a minimum wage, then they must consider it "the point at which a wage earner is no longer in deficit". I interpret this to mean that at the minimum wage, the worker is at a "net zero"; neither in deficit or profit. AND, if the government has set a mimimum wage, have they (by default) also not set a "miminum tax"?

I’ve been studying this issue for a time.

If there was a law that clearly and unambiguously showed that Cryer had to pay taxes, then the government only needed to show the jury the law, and he would have been found guilty.

But they could not show the jury that law.
What does that tell you?

Being “30 something” - the most distressing “tax” to me is the ungodly amount of “social security tax” that’s taken out of my paycheck especially when I know I’ll never see it in my old age.

I’d let the gov’t keep all I and my employers have paid in if they’d just stop taking it out.

I like the fair tax idea - I think it would level the playing field in all areas - instead of rewarding having a passel of kids by way of the earned income tax credit, and illegals skirting the system, everyone would pay. I feel the same way about the “school tax” here in Texas - get it off the backs of homeowners and make it a “sales tax” of sorts.

Sure, if you want to continue to be the tax collector for the globalists who are determined to control the US. Otherwise, you'd simply call for a return to tariffs, which puts America's economic reins back in the hands of the people.

This organization will not be abolished, because it is the government’s way of implementing a social welfare system for people who would never get a job in the private sector.

It's not a question of getting rid of the IRS. The IRS collects a lot of taxes besides the so-called income tax; however, the income tax is collected illegally and if the law were correctly obeyed, no one would be prosecuted or have one's property seized as regards this phony tax.

It's patriot and martyr, Irwin Schiff, who exposed the lack of liability for the income tax (liability is the only basis for a mandatory taxation per the privacy act).

What does that tell you?

Tells me a lot. But in a related note -- this guy isn't the first to make such a claim. The notion that there is no law on the books which says we have to pay taxes is not a new notion.

So why hasn't the government written such a law?? There appears to be this giant loophole, and the government (apparently) has been quietly hoping that no one notices it. Weird.

If the government sent you a form every year that said:
How many murders did you commit last year? ____ (enter number even if zero)

AND compelled you to fill out the form...
AND said that the form could be used against you...

It would be blatantly unconstitutional.
