Number 4 does not have to be addressed with a constitutional amendment. The way it is worded and the notes from the discussion during the time of writing the 14th amendment leave it clear that the Federal government can change the definition to a baby born in the US to persons in the US legally and accomplish what you want.
All it would take is to add the definition of who is born in the US into the legislation to fix #4.

Very true. The situation is still terrible. If the bill passed it would have been horrific. So its nice things aren’t that bad but they still stink.
Claire McCaskill (D) freshman senator from Missouri said she could think of no scenario under which she would vote for this bill. I didn’t vote for her, but God Bless her! She knows she won a squeaker and had the good sense to know she’d better not ignore her constituents on this one. She said that if the bureaucracy wasn’t capable of enforcing the 1986 law, she couldn’t imagine how anyone would think they could enforce this bloated, misguided bill.
I am very happy to say that my Senator Sherrod Brown voted against the bill. I wrote and called his office awhile back. I talked my fiancee into calling the other day. :)

This was one of those few and far between moments where elected representatives tried to shove something down the People's throats and the People told them to stuff it. AP, I think, said a "stake" was driven into the bill.
As expected, the drive-by media call this a defeat for Bush, ignoring all the Rats who pimped for it.
I’m happy for our country but sad for our President that it had to come to this. Even though I disagree with him,on this issue, I think he really thought a bad bill was better than no bill and cares about all the people here. If he will secure our border, no promises of money, no fancy virtual stuff, I’m willing to listen to his ideas about dealing with the ones already here. As far as all the senators that were pushing this for whatever reason, “see ya at the polls”. Maybe I should, but I have no sympathy for them. JMO

Both RINOs and Dems wanted to ride the wave of increased support from the national Hispanic community going into the 2008 election. The American people want enforcement of current laws and a secure border and they rejected both the RINO and the Dim initiative by Harry Reid to ram this bill through the House while American citizens were supposed to be asleep waiting for the 4th of July weekend.

The Senators who voted "Nay" understand that their future election prospects would be dim if they voted "Yea." The message got through to them, thank G_D.
But the problem is still there. Who will act to secure the Southern border? Not the Feds. Must we rely on Minutemen to do so, and other groups who are vigilante motivated?
A border war has evolved in the Southern Tier of our states, as Illegal Alien aggression accelerates under the auspices of Mexican communist revolutionaries formerly trained in El Salvador, drug runners and arms runners. And the Border patrol can't use force?
There is a war on our Southern border and the MSM refuses to report it, just like they refuse to truly report about the war in Iraq, that they just want to make go away.
Meanwhile our Senators fiddle while Rome is burning.They need to free up our border patrol and citizen minutemen to fight that war.

Cross hangers? I'd like you to explain that one please. Also, your attempt to contrast our relative desire for up or down votes in the immigration and judge confirmation situations mixes apples and oranges. In the case of the immigration bill, it is perfectly reasonable to be in favor of voting against cloture (and thus, to continue a filibuster), as this is a normal part of the legislative process. On the other hand, the DemonicRats' use of the filibuster to prevent judicial appointees from ever seeing an up or down vote was a different and nearly unprecedented use of the filibuster, and thus we rightly complained about it.
As for "hyperventilating", I believe you greatly underestimate the danger the Country faces if the amnesty advocates ever succeed. The United States is what it is because of its founding principles, principles which are alien to most illegal Mexican and Central American invaders, and principles which people with so little education and regard for our laws and sovereignty would happily flush down the toilet in exchange for a few more handouts from the panderers in the White House and Congress. If we EVER legalize tens of millions of these people, giving them the right to vote, it is GAME OVER for the United States as we know it. The DemonicRats know this, which is why they are pushing so hard on it (the RINO's are doing it for other reasons). The Dem's are desperately trying to create a new impoverished majority which they can make dependant on their largesse. That's their stock-in-trade. If they are successful, they will be able to implement every insane policy you can possibly imagine. That is why we are so adamant about holding the line on this issue. I believe illegal immigration, followed closely by its enablers, diversity and multiculturalism, is the number one threat to our Nation, even greater than the threat posed by terrorism.

We're in complete agreement regarding the above. Complete. I was glad to see this bill defeated in the process (as I've said for over a week it would be!).
Where I have a problem is with the tremendous disrespect and utterly nutcase-ness of a segment of our base regarding having a difference of opinion on this matter with our POUTS GWB.
To have a thriving, improving Limited Republic our party has to be big enough to allow for disagreement on issues (not having a bunch of cookie-cutter cutouts in suits). I didn't agree with the WH position on this issue (just as many didn't agree with R. Reagan's back in 86)....But that is completely different then saying the POTUS GWB is a failure, a traitor, an idiot, needs to be impeached, blah, blah, blah.....cry the sky is falling BS.
The system worked. This bill was defeated within the process. Hyperventilating over a single cloture vote like so many did earlier this week was silly.
Seeing that some of our base is made up of the same ilk of the DEM left (only with better politics 90% of the time) is sad to witness.

Interesting 70% of Democrats suppored the amnesty bill, 75% of Republicans voted against it.
Very nice....I finally got to work after the vote today (took the first 2 hours off) and am still euphoric.
