A University of Colorado committee has recommended that a controversial professor accused of faulty research be suspended for one year rather than fired, his attorney said.
Ward Churchill, a tenured professor of ethnic studies, touched off a national firestorm with an essay that compared some of the 2001 World Trade Center victims to Adolf Eichmann, a key planner of the Holocaust.
It was some of his other work, however, that led an interim chancellor of the Boulder campus and an another committee to recommended Churchill be fired.
The professor was accused of misrepresenting the effects of federal laws on American Indians, wrongly claiming evidence indicated Capt. John Smith exposed Indians to smallpox in the 1600s, and claiming the work of a Canadian environmental group as his own.
After the firing recommendations, he requested a review by the university faculty's Privilege and Tenure Committee.
Churchill attorney David Lane said Tuesday that he didn't think Churchill should be disciplined at all, but he said the Privilege and Tenure Committee members were at least moving in the "right direction."
"This will make it more difficult for Hank Brown (president of the University of Colorado system) and the regents to fire him," Lane said.
Brown could still decide to fire Churchill, give him a lesser punishment or close the case.

Among other things, Churchill was found guilty of passing off others’ work as his own (plagiarism), but also of passing off his own work as others’.
This “permits the author to create the false appearance that his claims are supported by other scholars when, in fact, he is the only source for such claims”...

This endless procedure seems byzantine to me. Can the Fake Indian be fired despite this recommendation?
Campos is a liberal. He is one of the few CU professors to take this stand.
Brown can ignore the committee : do nothing, do a suspension, or fire Ward ( I believe ).
Then there could be Ward’s lawyer filing appeals for years ?
Ward is still getting his full salary plus benefits with no classes ( last I heard ).
The lawyers will do very well by this.
Although, perhaps not Ward's. As I understand it he took this on a contingent fee, so if Ward appeals and loses, he may be out. Of course, he's gotten loads of free publicity in the mean time.

Churchill’s original 1978 application to the school for a position as a lecturer in Native American studies included a completed federal affirmative action form, on which he claimed “American Indian” ethnicity, according to records obtained Thursday by KHOW radio talk show host Dan Caplis through open records law requests to CU.
A second document obtained by Caplis, a 1990 application by Churchill for the position of associate professor of American Indian Studies, prior to his receiving tenure, also shows that Churchill claimed “American Indian” status.
An affirmative action data collection form shows that 11 American Indians applied, but only two, including Churchill, were interviewed.

The committee gave its report to Brown on May 8. It was not released to the public.
Brown has 15 business days to consider the case and could decide to fire Churchill, give him a lesser punishment or close the case.
If Brown and the board agree on a punishment less severe than firing, the case would be closed.
If Brown recommends that Churchill be fired against the recommendation of the committee, the committee can issue a second report. If Brown decides again to fire him, he would send his recommendation to the regents. Churchill would have 20 business days to request a private hearing with the board.

It looks like old Ward is just another fat baby-boomer. Is he the only one who sat in front of a tv with rabbit ears circa 1959 and said, “Yeah! I want to be Tonto - not that nasty Lone Ranger.”

Colorado high school geography teacher Jay Bennish plans to bring suit in federal court in order to be re-instated in the classroom after he was suspended for comments he made during a class lecture. Bennish is being represented by attorney David Lane, who also represented Ward Churchill, the University of Colorado professor who received national notoriety when he compared Americans killed on 9/11 to Nazis.

How about that recent case in Ft. Collins where the math teacher got caught giving a story problem on a test referring to Republicans as "liars." Then he came up with some unbelievable story that he used a second version of the test referring to the Dems that way. Riiight.
