Gutierrez/Flake Introduce Amnesty/Guestworker Legislation Bill To Be Taken Up After Senate Action
On March 22, Rep. Luis Gutierrez (D-IL) and Rep. Jeff Flake (R-AZ) introduced H.R. 1645, the Security Through Regularized Immigration and a Vibrant Economy (STRIVE) Act. The bill would grant amnesty to nearly all of the 12 million illegal aliens in the United States by one of several routes.
It would grant amnesty to illegal aliens by giving those here illegally since June 1, 2006, "conditional nonimmigrant" status (which lasts for six years of work here in the United States), then allowing them and their immediate families to become lawful permanent residents (LPRs).
In order to be eligible, an illegal alien would have to meet certain conditions, including: (1) payment of fines; (2) payment of back taxes for any period before being granted "conditional" status; (3) satisfaction of English language and U.S. history and civics requirements; (4) "touching back" (i.e., leaving the United States and being re-admitted at a port of entry equipped with the entry component of US-VISIT) before being granted LPR status (although several exceptions are allowed); (5) undergoing a medical examination; and (6) clearance through security and background checks.
For those few not captured by the above amnesty, the bill would grant amnesty by canceling the removal of, and adjust to conditional LPR status, an illegal alien who demonstrates that he/or she has maintained continuous presence in the United States for the five years preceding enactment and has met other specified requirements.
Another redundant amnesty in the bill would allow illegal alien farm workers to obtain a "blue card" granting "temporary" legal status for themselves and their families if they could show they have worked in the U.S. at least 863 hours or 150 work days (5.75 hours constituting a work day) during the preceding two years. These "blue card" illegal aliens could subsequently apply for legal residency, provided they meet certain requirements.
In addition, the bill would: (1) establish the H-2C "guestworker" program, through which 400,000 "new workers" (plus their spouses and minor children on an unlimited basis) may come to the United States annually to perform labor or services for which no unemployed U.S. citizens living domestically can be found; (2) more than double the number of employment-based (EB) immigrant visas available annually; (3) repeal existing statutory provisions denying illegal aliens´ eligibility for in-state tuition unless a U.S. national is similarly eligible without regard to state residence; (4) require employers to verify the eligibility of new hires; and (5) make some improvements in border security (e.g., more enforcement personnel, strengthened infrastructure, better equipment, etc.), but negate the effectiveness of these improvements by putting in place policies that undermine U.S. sovereignty.
Shortly after the bill´s introduction, House Speaker Nancy Pelosi (D- Calif.) issued a press release saying that H.R 1645 provides an "excellent framework for Congress and the President to begin work on the vital task of immigration reform." The fact that she is not backing the bill fully at this point, unlike her endorsement of similar legislation during the 109th Congress, is indicative of the competing pressures that she and other open borders advocates face in the current debate.
The Washington Post reported that Speaker Pelosi believes that a "comprehensive" bill will not pass her chamber with only Democratic votes. In addition, if the Bush administration is unable to garner at least 70 GOP House votes for an amnesty plan, Speaker Pelosi indicated that she will not bring a "comprehensive" plan to the floor for a vote.
House Judiciary Immigration Subcommittee Chairwoman Zoe Lofgren (D-Calif.), who will likely have primary responsibility for shepherding an immigration bill through the House this year, has begun a series of hearings on various aspects of the issue.The plan is to report H.R. 1645 from committee some time in June, and to begin floor action in July.

The biological offspring of American citizens. If born on U.S. soil, that person is a "native born" American eligible to run for the Presidency after reaching age 25. All other Americans are those who have applied for citizenship by established naturalization procedures, completed the requirements and sworn an oath. Everyone else is a transient tourist or an illegal alien.

Your view is flawed because the anchor babies are born here. That makes them Americans. American citizenship cannot be biological. The 14th Amendment is clear that those born here are American. Even if the parents are illegal.
It seems like the status is that the bill is still in committee. Was it pushed to the House floor, passed, and moved to the Senate? I didn't see any House floor vote results.
The Constitution has to be viewed in historical perspective.
The 14th Amendment was passed to cover newly freed slaves born in the U.S., not a bunch of damn border sneaks who come here to deposit their babies like cowbirds in somebody else’s nest.
Court decisions which have not taken into account the genesis of the 14th Amendment are the product of fraudent decisions based on loose constitutional interpretations.
The 14th amendment is clear; all PERSONS born or naturalized.

How is the Senate considering a bill of the House when it hasn’t been passed or cleared out of the House?......
The 13th, 14th and 15th Amendments were ALL directed at the South post civil war, and were adopted in 1865, 1868, and 1870 respectively.
further, the 14th amendment contains Section II which addresses participation of ex-confederates in the voting process and former black slaves in being counted for representation purposes, Section III of the 14th Amendment deals specifically with holding of office by ex-confederates, and Section IV concerns debts incurred as a result of the Confederate War effort.
The entire set of articles were aimed at the situation post-civil war and the section I of the 14th Amendment was specifically devised to prevent former confederate states from disenfranchising ex-slaves, NOT protecting modern day invaders who violate our border laws.
