Dear Mr Robinson:

We are writing on behalf of our client, the Democratic National Committee (DNC).

A post by “coffee260” on FreeRepublic.com today states that this morning, on the Quinn & Rose show on XM, co-host Quin stated that the DNC chairman, Gov. Howard Dean had called Gov Kathleen Sebelius (D-Kans) “around 5:00am on morning after a tornado destroyed the town of Greensburg, Kansas and discussed with here what to say about the tornado and how to blame the war in Iraq and the Bush administration on a slow response to the aftermath.”

The statement was made by Mr Quinn, repeated on FreeRepublic, is demonstrably, unequivocally and absolutely false. Gov Dean had no such conversation with Gov Sebelius, ever.

No effort was made by FreeRepublic to contact anyone at the DNC for comment or to check the accuracy of these statements before they were published. FreeRepublic not only repeated this statement, but further stressed that Quinn’s “source” was extremely reliable and in a position that would give him direct knowledge of these revelations.

The statements quoted above are false and defamatory, are libelous and slanderous and clearly threaten to interfere with the DNC’s operations and ability to solicit support and raise funds by predjuding the organization in the eyes of the Democratic Party supporters and the public. For these reasons, we demand that FreeRepublic immediately cease and desist from Further dissemination of the above quoted statements or any statements similar in substance and immediately post a retraction of these statements in a location on its web pages at least as prominent as that on which the original story appeared.

Please let us know by noon, May 11, 2007, whether you intend to comply with these requests.

From February 1993 until May 1998, Mr. Sandler served on the staff of the DNC as general counsel. He continues to serve in that position through his law firm. In this capacity, Mr. Sandler has been responsible for all legal matters affecting the national party.

I assumed he was doing Pro boner work but that would be redundant.

We all know how these ratbastards parse words. It depends on the meaning of the word “conversation.”

If perhaps Dean left a message on her machine, he did not have a conversation with her.

If he sent an email, that wouldn’t be a conversation.

If he recorded it and played it to her while on the phone, that wouldn’t be a conversation.

If he had an aide hold the phone and repeat the words to the gov, that wouldn’t be a conversation.

If he faxed it, that’s not a conversation.

If she said nothing at all, that would just be a statement by him; they would not have had a conversation.

With all due respect, the Quinn and Rose show was issued a cease and desist, and they have refused to take it off their web site. Apparently the “source” is someone they know and trust regardless of possible legal action. I am going to watch this one with anticipation. I have always believed Howard Dean would make a serious mistake, and I think he has finally made it. Will this hurt the Dems or the Reps? Who will it impact? And what will the response be from Joe and Jane public? Well, I believe the only one who will be stung on this will be Dean, and possibly Kathleen Sebelius.

Just my honest opinion.

Jim Robinson doesn’t need to reply. An posting appeared on this FORUM, the DNC threatened him and demanded specific performance, he has (as far as I can tell) ignored the threat/demand. He’s not required to respond to the DNC or to you. If he agrees with them he takes the post down, and posts a correction. If not, he ignores them (and you).

I’m curious why you want to see a response from him. Are you doubting that the radio broadcast actually occurred?

I am sure there is plenty of glee in moveon land, but these tactics should backfire with well-reasoned people. Stifling free speech is never a good idea because it can cut both ways. I am sure some of it may be testing of the waters for the fairness doctrine. HR3303 is in the background as well. This story would have been dead and in bed today most likely so resurrecting it plays no role other than to intimidate (which didn’t work) and fire up the minions which from DU’s standpoint didn’t do too much.

I'm coming in a bit late to this discussion - but I have to wonder if maybe this story was originally planted on that XM Radio program to generate exactly this response. It gives that idiot Kansas Governor the ability to act all outraged and disparaged and victimized by the evvvvillll Republicans ... which means she really isn't being held account for how she blantantly lied about the Guard situation in her state and got b*tch-slapped with the facts by the White House ...

Actually they have yet to get anything last I heard. The DNC sent a C and D to XM Radio. Emails returned from the orgin, Quinn and Rose, said nobody said anything to them.
