Social Dancing Banned In New York

Appeals Court Rules Ban Is Constitutional

NEW YORK -- Should you find yourself in a bar in New York City, and the music playing makes you want to get up and dance, please resist the urge.

A state court on Thursday upheld the city's Prohibition-era law that bans social dancing in bars, restaurants and certain clubs.

Those who like to get up and boogie sued, arguing the law illegally infringes on their right of free expression. The city's Cabaret Law, which was enacted 80 years ago, bans social dancing in all but specially licensed venues.

The Gotham West Coast Swing Club and several people filed a lawsuit complaining that because the Cabaret Law barred them from dancing with other people, it illegally infringed on their right of free expression.

The appeals court disagreed, saying recreational dancing is not a form of expression protected by the federal or state constitutions.

Plaintiffs lawyer Norman Siegel said he was "very disappointed" by the decision and is considering an appeal.

Yes it is. But it also came in tow with jackboot agents calling police to people incidently dancing in place by jukeboxes and getting ticketed.

Many of the dance clubs were located in residential neighborhoods. Bar closing in NYC is 4 a.m. So, you have a 15,000 sq ft club and 400 pouring out in the middle of the night. It also allowed them to shutter a lot of the problem clubs.

Obviously, if you're in your local ginmill and start dancing to the juke nobody is going to stop you.

In NYC the intent of the law is often different than the letter of the law itself.

Ramzi Yousef has two congregates in shabby, shopfront, mosques. They were in Brooklyn and New Jersey.

There was a computer seized in Brooklyn that had documents relating to Operation Bojinka on it. But the actualy bomb was built in Ramzi Yousef's storage facility that was converted into a bomb making factory in Jersey City, NJ.

its not stupid from the view of whatever board licenses facilities and insurance companies. they could charge seperately for:
live bands
stand up comedy
dancing
DJ
karaoke
pool/ darts
arcade

local gov't and insurance love these type of stupid laws. anything that gives them an excuse to charge more.

So, the current decision is based on the negative social effects of second-hand dancing; do they have an 80 year old law on public yawning?
