San Francisco police investigators on Tuesday submitted the findings of their criminal probe in the Baker's Dozen case to prosecutors, who now must decide whether to file charges in the alleged New Year's assault on members of the Yale singing group.
The district attorney's office confirmed that discussions are under way with police, who have been criticized for not making arrests at the scene or immediately investigating the incident, which allegedly began with homophobic epitaphs being hurled during a house party in the Richmond District and ended with members of the all-male a cappella group saying they had been punched, tripped and kicked.
Debbie Mesloh, spokeswoman for District Attorney Kamala Harris, said late Tuesday that there were "ongoing discussions'' about the case. She would not say when prosecutors might make a decision on whether to file charges.
On Friday and Saturday, a total of 15 members of the singing group -- on tour in Southern California -- were interviewed by police investigators who flew down to take statements and then returned to complete the investigation.
The most seriously injured singer, Sharyar Aziz Jr., who returned to New York after suffering a broken jaw, already had told police he was attacked leaving the party as he walked to a nearby home where members of the group were staying. Aziz was left with his jaw broken in two places.
Another singer, Evan Gogel, suffered a concussion and two black eyes. According to a lawyer representing members of the Baker's Dozen, Gogel and another singer, Bryan Bibler, together identified four men who had been detained at the scene as their attackers but the men were not arrested.
Patrol officers allowed the detained men to go free after taking their names.

ALLEGED ASSAULT? One man had his jaw broken. There WAS an assault, the question is who should be charged.
Motive may be in question (don't like glee club, don't like songs about America, jealous boyfriend), but there WAS an assault. This is why "hate crimes" laws are bogus.
What the heck are they teaching at Journalism school these days - it certainly ain't proper word use:
"epitaph" - "an inscription on or at a tomb or a grave in memory of the one buried there"
The proper word would be "epithet" - " a disparaging or abusive word or phrase".
Editor didn't catch it, either.
Well if they shouted "Faggot, you're history!" that might be considered a homophobic epitaph.

I read in the paper last week that they think the incident started because several of the singers (and the hostess) went to one catholic high school, and the attackers went to another, rival catholic high school and were current students or recent graduates
