Prosecutors dropped rape charges Friday against three Duke University lacrosse players accused of attacking a stripper at a team party, but the three still face kidnapping and sexual offense charges, a defense attorney said. Joseph Cheshire and attorneys for the other players have said for months the woman told several different versions of the alleged assault.
Cheshire said Friday that the accuser now says she does not know if she was penetrated, which he said led District Attorney Mike Nifong to dismiss the rape charges.
Nifong did not immediately return calls seeking comment.
The accuser, a 28-year-old student at North Carolina Central University, has said three men raped her in a bathroom at a March 13 team party where she was hired to perform as a stripper.
The players _ Dave Evans, Collin Finnerty and Reade Seligmann _ all say they are innocent. Their attorneys have consistently said no sex occurred at the party and have cited a lack of DNA evidence in the case as proof of their clients' innocence.

The remaining charges will no doubt be dropped too. This whole case was beyond pathetic. Mr. Nifong should be removed from office and disbarred.
Bogus charges to begin with....
But the whole scenario played into the prejudices of the local voters, and managed to use class warfare as an election strategy.
Nifong was a hopeless panderer, and he made it pay off.

Give me a ****ing break! These guys are going to have their lives ruined by some lying bitch and a dick of a prosecutor and she'll get money from Jesse Jackass and Nifong will get to continue his term. I hope that the families of these guys sue and win a large amount of money.
Nifong is vermin, pure and simple. He should spend the next twenty years in the big house with his former clients, for his crimes.
The defnedent has changed her story so many times, that she has become a totally unreliable witness, and her testimony is the ONLY shred of evidence Nifong has at all.
And after a successful prosecution, he needs to be tarred and feathered. Oh, and disbarred live on all networks.
DUH defnedent of course means the accuser... must lrntoproofread.

Nifong is trying to milk it for all its worth, and only dropping the rape charges because he knows the jig is up.
But he'll be damned if he lets them off completely (and consequently admits he is totally wrong about his lying slut). He'll try to save face by continuing to pursue "sexual harrassment".
It's a political game.
He's trying to save face by tacitly not admitting that nothing happened.
He had to give into the obvious that no rape happened. But doesn't want to give up totally.
