ATLANTA A suburban school board that put stickers in high school science books saying evolution is "a theory, not a fact" abandoned its legal battle to keep them Tuesday after four years.
The Cobb County board agreed in federal court never to use a similar sticker or to undermine the teaching of evolution in science classes.
In return, the parents who sued over the stickers agreed to drop all legal action.
"We certainly think that it's a win not just for our clients but for all students in Cobb County and, really, all residents of Georgia," said Beth Littrell of the American Civil Liberties Union of Georgia.
The school board placed the stickers inside the front cover of biology books in 2002 after a group of parents complained that evolution was being taught to the exclusion of other theories, including a literal reading of the biblical story of creation.
The stickers read: "This textbook contains material on evolution. Evolution is a theory, not a fact, regarding the origin of living things. This material should be approached with an open mind, studied carefully and critically considered."
A federal judge ordered the stickers removed in 2005, saying they amount to an unconstitutional government endorsement of religion. The school board appealed, but a federal appeals court sent the case back, saying it did not have enough information.
"We faced the distraction and expense of starting all over with more legal actions and another trial," said board chairwoman Teresa Plenge. "With this agreement, it is done and we now have a clean slate for the new year."
School board attorney Linwood Gunn said the agreement is not an admission that the stickers were unconstitutional. "The school board attempted to reach what they thought was a reasonable compromise," he said.

Answers in Genesis is a moneymaking scam, just like Hovind.
They are only around to soak the ignorant and tell them what they want to hear.
I've explored AIG many times, its full of ignorance, garbage and terrible junk pseudo science.
Bringing in Pasteur and Curie is silly. Its almost 2007, real science exists, its out there, being tested daily. The fact is that you would rather ignore that which doesn't fit your dogma, that is a closed mind.
I've been on FR long enough to surmise when a poster resorts to personal attacks then they know they have lost the discussion. I must have hit quite a nerve with you. Do you have smoke coming out of your ears? I'm flattered. Merry Christmas!
Yeah, still up, so are you.
Would Einstein advocate teaching fables like Noah's Ark in public school rather than real science?
I've been on FR pretty long too, long enough to know that someone that wants to force their dogma on everyone is one that can't be trusted with intellectual discourse.
No smoke out of my ears, just reason and logic and the satisfaction that the ID/Creationist crowd has lost yet another battle.
You need someone to love you and feed you pancakes. Adieu!
My rejoinder: "Of course this is a nonsensical statement standing on it's own. It's both a false statement and evidence of a Marxist point of view."
Your amended statement after the nonsense: "I made my position clear, no religion in public schools, unless you preach all religions. So, if we teach creationism, we must teach Odin and Norse mythology."
This statement is somewhat better but not accurate. Whether you want religion in school or not is really of no concequence. The US Constitution has no problem with religion in school. It does have a problem with government actors favoring one religion above all others according to the latest jurisprudence. The courts would certainly look askance at public schools whose teachers were evangelizing one religion but the same court would be out of line in prohibiting individual students from doing the same on their own time in that same public school.
Your first statement was marxist in nature, the second statement was simply hyperbole sprinkled with some truth.
Happy New Year!
305 is for you.
Wow, great agumentation skills.
LOL
Honestly, I wouldn't know. He's dead. Maybe you can ask him.
At least you appreciate my sense of humor. :)
Wow, what a circus!
Here you got a thread where posters who are known, among other things, for saying fire-breathing dragons are real, the U.S. moon landings were faked, lifesaving cancer surgery is immoral and (believe it or not) that heliocentrism is controversial trying to lecture scientifically knowledgeable people on the validity of a theory (evolution) that has been known to be true for over a century. Unbelievable. Put your Bibles down for a few minutes and get a real education, folks! Science has advanced a bit since the Bronze Age!
No wonder more and more educated conservatives want nothing to do with the ignorantly fanatical crankhole the once-great science threads on this site have become.
For what it's worth, I love ya Quark ;) Your ears are real cool. Happy New Year to you.
Amen.
Quark has another meaning. I never cared much for the new Star Trek shows.
