The U.S. Senate on Friday overwhelmingly agreed to authorize construction of a fence along the U.S. border with Mexico, sending to President George W. Bush before the November 7 elections a bill that Republicans hope will showcase their efforts to stop illegal immigration.
The Republican-written bill authorizing construction of about 700 miles of fence was one of the last bills to clear Congress as lawmakers prepared to leave Washington to campaign for the congressional elections. On a vote of 80-19 the Senate approved the bill already passed by the House of Representatives and it now goes to Bush for his signature.
Bush had sought broad immigration legislation that would create a guest-worker program to help provide a steady workforce for jobs Americans are either unable or unwilling to do. But he was unable to marshal support for it in the face of opposition from a solid group of House Republicans who pushed for tougher enforcement and border measures instead.
A separate bill approved by the House on Friday provided an initial $1.2 billion in funding for the fence and other border-security measures for the fiscal year that begins Oct 1. The money is part of a $34.8 billion bill for domestic security programs for the fiscal year that begins October 1.
The broad spending bill also criminalizes the construction of tunnels that could be secret passageways from Mexico or Canada for drug smugglers, illegal aliens or terrorists.
The Senate was expected to pass the funding bill quickly and send it on to Bush along with the fence authorization.
Opponents of the fence said it would be expensive and was not an effective deterrent to illegal immigration.
"This is a political gimmick," said Sen. Ken Salazar, a Democrat from Colorado. "It is not in the long-term interest of of the United States of America and the Western Hemisphere."
The government of Mexico on Thursday issued a statement expressing "its profound concern" with the fence. The statement, translated from Spanish, said such measures "are contrary to the spirit of cooperation that should prevail to guarantee security in the common border."
IMMIGRATION OVERHAUL
Backers of the fence said it was an important tool to clamp down against illegal immigration. An estimated 1.2 million illegal immigrants were arrested in the last fiscal year trying to cross into the United States along the border states of Texas, New Mexico, Arizona and California. Sections of the fence would be built in each state.
"Fortifying our borders is the first prong of comprehensive immigration reform and it's an integral piece of national security," said Senate Majority Leader Bill Frist, a Tennessee Republican.
Lawmakers and analysts say Congress could tackle comprehensive immigration legislation in a post-election sessions, but they acknowledge difficulties.
"It will be tough but doable," said Rep. Adam Putnam (news, bio, voting record), a Florida Republican.
"There is a lot of pent up pressure and interest in doing something in the lame duck session," said Craig Regelbrugge of the Agriculture Coalition for Immigration Reform.
Democrats accused the Republican majority of playing politics with the fence bill after raising immigration as an election-year issue but having little to show in the way of legislation.
"This is about November. This is about incumbent protection, not about border protection," said Senate Democratic Leader Harry Reid of Nevada.
Earlier this year the Senate passed broad immigration legislation that combined border security and employer sanctions with a plan to create a guest-worker program and provide a path to citizenship for many of the 12 million illegal immigrants living in the United States.
The Senate and House were unable to compromise and instead resorted to passing a series narrow border security measures.

Republic of Texas didn't have much controll in the region between the Rio Grande and the Nueces rivers. Of course neither did the Mexican govenment.Which brings up an interesting point to advocate on behalf of the devil.
If they didn't have much control over it then, and Texas became a great state as such.....what's the big need for a fence now?

I sure hope they do it and I wonder what kind of fence they are going to build and if they will patrol it or they will have a door to let the illegals pass through. I also wonder whether they will build the rest of the fence to really secure the borders. I hate to sound pessimistic; but our government is always lying to us.

Because the federal government in Washington, DC abdicated its responsibility for the last four decades with respect to controlling the border. The DemocRATS have championed wide open borders as a way create a dependent population that can be cultivated to vote for DemocRATS. Now that the effects of unrestricted immigration aren't just confined to border states, DemocRATS are losing support from other groups like working class whites and labor union members, so now there is a more bipartisan interest in controlling the border.
There was a faction in Texas that wanted to keep Texas an independent republic. Former President of Texas Mirabeau B. Lamar wanted to expand Texas all the way to the Pacific ocean. He wanted what became the states of California, New Mexico, Arizona, Utah, Colorado, and Wyoming to all be part The Republic of Texas. Of course Texas lacked the population to field an army big enough to defend the area it already claimed much less the area Lamar wanted to annex. Annexation of Texas by the US was the only way Texas could protect itself long term from another invasion by Mexico to reassert claims to the disputed region between the Rio Grande and Nueces rivers or all of Texas.

Building a Berlin Wall did not dry up Berlin. It will not dry up the illegal alien stream. All this will do is raise the prices Coyotes charge to smuggle.
This law was passed by cowards that were pandering to knee jerkers, whatever the outcome, it was not passed by people that were honestly trying to solve the problem of illegal immigration.
30 some-odd Democrat Senators voted FOR this, so there must be something fishy about it!

AN ACT
To establish operational control over the international land and maritime borders of the United States.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Secure Fence Act of 2006'.
SEC. 2. ACHIEVING OPERATIONAL CONTROL ON THE BORDER .
(a) In General- Not later than 18 months after the date of the enactment of this Act, the Secretary of Homeland Security shall take all actions the Secretary determines necessary and appropriate to achieve and maintain operational control over the entire international land and maritime borders of the United States, to include the following--
(1) systematic surveillance of the international land and maritime borders of the United States through more effective use of personnel and technology, such as unmanned aerial vehicles, ground-based sensors, satellites, radar coverage, and cameras; and
(2) physical infrastructure enhancements to prevent unlawful entry by aliens into the United States and facilitate access to the international land and maritime borders by United States Customs and Border Protection, such as additional checkpoints, all weather access roads, and vehicle barriers.
(b) Operational Control Defined- In this section, the term `operational control' means the prevention of all unlawful entries into the United States, including entries by terrorists, other unlawful aliens, instruments of terrorism, narcotics, and other contraband.
(c) Report- Not later than one year after the date of the enactment of this Act and annually thereafter, the Secretary shall submit to Congress a report on the progress made toward achieving and maintaining operational control over the entire international land and maritime borders of the United States in accordance with this section.
SEC. 3. CONSTRUCTION OF FENCING AND SECURITY IMPROVEMENTS IN BORDER AREA FROM PACIFIC OCEAN TO GULF OF MEXICO.
Section 102(b) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (Public Law 104-208; 8 U.S.C. 1103 note) is amended--
(1) in the subsection heading by striking `Near San Diego, California'; and
(2) by amending paragraph (1) to read as follows:
`(1) SECURITY FEATURES-
`(A) REINFORCED FENCING- In carrying out subsection (a), the Secretary of Homeland Security shall provide for least 2 layers of reinforced fencing, the installation of additional physical barriers, roads, lighting, cameras, and sensors--
`(i) extending from 10 miles west of the Tecate, California, port of entry to 10 miles east of the Tecate, California, port of entry;
`(ii) extending from 10 miles west of the Calexico, California, port of entry to 5 miles east of the Douglas, Arizona, port of entry;
`(iii) extending from 5 miles west of the Columbus, New Mexico, port of entry to 10 miles east of El Paso, Texas;
`(iv) extending from 5 miles northwest of the Del Rio, Texas, port of entry to 5 miles southeast of the Eagle Pass, Texas, port of entry; and
`(v) extending 15 miles northwest of the Laredo, Texas, port of entry to the Brownsville, Texas, port of entry.
`(B) PRIORITY AREAS- With respect to the border described--
`(i) in subparagraph (A)(ii), the Secretary shall ensure that an interlocking surveillance camera system is installed along such area by May 30, 2007, and that fence construction is completed by May 30, 2008; and
`(ii) in subparagraph (A)(v), the Secretary shall ensure that fence construction from 15 miles northwest of the Laredo, Texas, port of entry to 15 southeast of the Laredo, Texas, port of entry is completed by December 31, 2008.
`(C) EXCEPTION- If the topography of a specific area has an elevation grade that exceeds 10 percent, the Secretary may use other means to secure such area, including the use of surveillance and barrier tools.'.
SEC. 4. NORTHERN BORDER STUDY.
(a) In General- The Secretary of Homeland Security shall conduct a study on the feasibility of a state of-the-art infrastructure security system along the northern international land and maritime border of the United States and shall include in the study--
(1) the necessity of implementing such a system;
(2) the feasibility of implementing such a system; and
(3) the economic impact implementing such a system will have along the northern border .
(b) Report- Not later than one year after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report that contains the results of the study conducted under subsection (a).
SEC. 5. EVALUATION AND REPORT RELATING TO CUSTOMS AUTHORITY TO STOP CERTAIN FLEEING VEHICLES.
(a) Evaluation- Not later than 30 days after the date of the enactment of this Act, the Secretary of Homeland Security shall--
(1) evaluate the authority of personnel of United States Customs and Border Protection to stop vehicles that enter the United States illegally and refuse to stop when ordered to do so by such personnel, compare such Customs authority with the authority of the Coast Guard to stop vessels under section 637 of title 14, United States Code, and make an assessment as to whether such Customs authority should be expanded;
(2) review the equipment and technology available to United States Customs and Border Protection personnel to stop vehicles described in paragraph (1) and make an assessment as to whether or not better equipment or technology is available or should be developed; and
(3) evaluate the training provided to United States Customs and Border Protection personnel to stop vehicles described in paragraph (1).
(b) Report- Not later than 60 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report that contains the results of the evaluation conducted under subsection (a).

Go to Thomas gov. locator or either of the Congressional web sites and look for HR 6061 which I think is the number of the bill. I know it would be listed on the Senate site where I got the voting results.... It was passed in the Senate without amendment thus the House version stands.

This is the typical way Congress gets important, somewhat controversial, things done. It is simply silly for people to get upset about stuff not coming up for a vote until election pressure looms. I'm more concerned when the House & Senate leaders bring things to a vote further from an election and allow the pressure effect to dissipate with time.
Frist and Hastert have been masterful during this session... right from the beginning, when Frist made some key decisions that brought looming pressure in the judicial filibuster area. Sadly, political neophytes don't realize just how essential the kind of behind the scenes horse-trading and strategic decisions are in the Senate. Hastert, on the other hand, has kept a strong hand on the tiller of the House.
Congratulations to both of them - it seems that Republicans have finally discovered a way to somewhat neutralize the filibuster power in the Senate.
