Illegals on their own if injured on the job (BOO-HOO)

Jose Hernandez was good with a machete. So he was the top choice when his boss needed someone to chop down young trees that were choking parts of Florida's Everglades.

On one trip to the swamps, the workers flew in by helicopter and quickly cut a stand of sprouting trees. But when they took off again, something went wrong: The chopper lurched left, then plunged into murky water. A broken rotor blade slashed through Hernandez's left thigh.

Doctors saved his life but couldn't save his leg. To pay for his costly medical care, Hernandez filed a workers' compensation claim, which covered some of his bills.

Then, the insurance carrier, Florida Citrus, Business & Industries Fund, discovered that Hernandez was in America illegally, without work papers or permission from federal immigration officials. It halted all payments and left Hernandez to languish in a low-income Florida nursing home, unable to work to support his wife and four children in Mexico.

Thousands of illegal workers like Hernandez are hurt on the job every year in America but don't get the compensation that's promised by law in every state.

As a retired Investigator for different Insurance companies in California (Where most Insurance companies have left, or no longer write specic types of policies) Illegal Aliens have drained the Worker's Comp system. About 85% of WC fraud is by Illegal Aliens. The State of California deems Illegal Aliens ENTITLED to WC.

If they get hurt, it pays them: A weekly check Medical costs Transportation to and from medical appointments A translator at those appointments

WC is being used as an Illegal Alien Retirement system. "Gethurt,m and get a check for the rest of your life. Get a PO box just across the Border, and live like upper middle class in Mexico.

Woulda never have happened if he'd not been here. Every time an incident like this occurs INS/DHS/BP/whomever should be investigating the employer.

screw all the illegal aliens...deport them...then any back payments due to the insurance companies should be paid by the empolyers...who should also be fined for hiring illegals....as for mexifornia....thye can do whatever they want..as long as the rest of the US taxpaers don't have to support them!!!

If illegals feel "on their own" when they're injured, then perhaps they should stay in the country of their birth or go to Canada. Simple solution.

California's problem with illegals is largely a fault of the state politicians. It is the State that deems them entitled to WC, in this case. If the politicians had any concern about this, they can pass law or whatever amendments necessary to eliminate the problem. They can impeach any judge who stands in the way of the law, and reinstate it.

Complain to the CA politicians.

I am really trying to feel sorry that this guy is sticking us with his medical bills and wants more of our money cause he is here illegally, hurt, and can no longer send money back to wife and kids in Mexico. Nope, can't do it. Send him back and let his own wonderful country and countrymen take care of him.

BECAUSE

discovered that Hernandez was in America illegally, without work papers or permission from federal immigration officials

And its not promised by law in every state Either unless someone pays for the service !

This sort of reminds me of what happens when people ask a body shop to "bury the insurance deductible" in the damage estimate. Then, when the body shop screws them, they're upset. Well, duh, if they'll cheat the insurance company, they'll cheat you too. Somehow the analogy just seems to fit.

If an employer is too cheap and sleazy to hire legal labor, do you think they're going to bend over backward to take care of someone who gets hurt on the job?

Good. They aren't in our country legally so they don't deserve the benifits of a citizen. They are already costing our hosptials billions a year and costing us a tremendous amounts in education and social services too.

Problem is there are so many hispanics there now that they'll always vote in enough pro-illegal and anti-rule of law candidates. Not to mention all the libs.

Don't forget the fact that it is (certain) Americans who keep hiring them because they are cheap labor.

If greedy businesses would pay a decent living wage ($12+ an hour), instead of lowballing all the time, they would have all the legal employees they want. But they are always trying to cut corners to squeeze out a few extra pennies of profit. And so Jose gets the job while Joseph keeps looking for work.
