(AP) -- Rush Limbaugh could see a deal with prosecutors in a long-running prescription fraud case collapse after authorities found a bottle of Viagra in his bag at Palm Beach International Airport. The prescription was not in his name. Limbaugh was detained for more than three hours Monday at the airport after returning from a vacation in the Dominican Republic. Customs officials found the Viagra in his luggage but his name was not on the prescription, said Paul Miller, a spokesman for the Palm Beach County Sheriff's Office. Miller said the alleged violation could be a second-degree misdemeanor. The sheriff's office was investigating and will soon turn the case over to the state attorney's office, which had no immediate comment Tuesday. Under the deal reached last month with prosecutors, Limbaugh was not to be arrested for any infraction for 18 months in exchange for authorities deferring a charge of ''doctor shopping.'' Prosecutors had alleged the conservative talk-show host illegally deceived multiple physicians to receive overlapping painkiller prescriptions. Limbaugh also must submit to random drug tests and continue treatment for his admitted addiction to painkillers. Limbaugh's doctor had prescribed the Viagra, but it was ''labeled as being issued to the physician rather than Mr. Limbaugh for privacy purposes,'' Roy Black, Limbaugh's attorney, said in a statement. U.S. Customs and Border Protection examined the 55-year-old radio commentator's luggage after his private plane landed at the airport, Miller said. Investigators confiscated the drugs, which treat erectile dysfunction. Limbaugh was released without being charged.

Scrips from two different MDs suggested me that Limbaugh exhibited addictive behavior (this is described better than I can do it in post 122). I have read of Viagra abuse in clubs when kids combine it with ecstacy, but had never heard of a problem with adults. So I did a search, and there is one.

Of course I meant to insinuate that Limbaugh is addicted. But whether he is or not, 1) taking perscription drugs through customs 2) bearing someone else's name 3) when you are on parole for oxycontin abuse is (to be kind) extremely poor judgement. It looks like Rush won the trifecta on this one.

Going to the Dominican Republic is also pretty stupid of him. Why not Tahiti or the Bahamas? The Dominican Republic sort of has a reputation as a gay sex haven.

Also, prostitution is legal there. He left himself open to all kinds of fun accusations going there with a bottle of Viagra not prescribed to him. Just an overall dumb move on his part.

How the fuc@ did this become public information anyway? It's nobody's business WHAT Rush had in his suitcase. If it was an illegal substance, fine. Someone deliberately singled him and his luggage out for harassment purposes, then violated his privacy by making a statement to the press. Viagra is NOT an illegal substance. It is OTC in certain countries in fact.

What evidence do you have that Viagraholics Anonymous -- your linked source -- isn't a big honking joke? Did you even browse the site? Did you notice that there is no one writing on the page who has a doctorate, a degree, or even a maddog P.O. Box?

That site has all the credibility of the homepage for Jukt Micronics, the phony company Stephen Glass created for a New Republic story. That is, unless, you are either "Jack" or "Ben". Sheesh!

Let me give you folks a time out here. I am a physician. I can't write a presciption for myself and then have one of my patients go and fill it for me. No pharmacy would allow this, first it would be a major HIPPA violation, second the medical boards would be all over me like stink on poop. The media is so full of $hit on this one. Rush was targeted by the left for harassment. When he came back from the Dom. Republic, they tore his luggage apart looking for illegal drugs, pain killers, etc. When they didn't find it, they made a public spectacle about finding Viagra. This was a political assasination attempt, nothing more. If Jeb is any kind of governor, he would pardon Rush now. The liberals are seeing that their grip on power is going away, probably forever, and they will stop at nothing to prevent it.

Have you traveled out of the country much? My baggage has been searched when I come back.

Considering that the Sherrif's county spokesman released the information, I'm not sure it wasn't a violation of privacy. I think if Rush wanted to keep it private, he should have had the prescription made out to his own name.

Viagra is NOT an illegal substance.

However, it IS illegal to use it when you do not have a legal prescription for it.

You're right. In addition, they often give out samples to see how patients will reeact to new medications. Only when it turns out the patient is responding properly do they write a scrip for the meds. That's expecially true with modern medical plans that usually call for 90 day scripts that are refillable three times.

The NYT is treating "the diversion deal" like probation (after conviction and finding of guilt). There is more leeway in a "deal", and yes he did not get arrested, did not commit a crime, did not violate alaw, etc.

Much as I hate to say it, you may be right. Rush is far from stupid, and any idiot with a scanner could fake the perscription label so it said "Limbaugh, Rush." And I can think of a dozen ways of attempting to slip small quantites of drugs past customs. How much work does it take to pull the bottom off a 35mm film roll, ditch the film and stuff it with pills? With all his recent troubles, would he be dim enough to carry someone else's perscription meds with him?
And Viagra, for cryin' out loud! What, was the evidence locker out of oxycontin that day?
Just wondering if the perscription might have belonged to his Lady. Viagara is being used with some success in treating women with certain sexual dysfunctions.

Sorry for being snappy. You are right, the official prescription is what matters, but if that doesn't match the label, then there is a pharmacist somewhere in a world of trouble... My point is that IF the doctor intentionally wrote the prescription in his own name to protect Rush's privacy as is claimed, then they are both in violation.

It is unlikely that this prescription was filled by a pharmacist. It is more likely that the drugs were dispensed directly to Rush by his physician. The question as to Rush is whether he obtained the drugs lawfully. If they were dispensed to him by his physician, he obtained them lawfully regardless of what the label said.

This is how the left plays the game, however. Find a fly spec of any kind on a conservative, blow it up into a felony, and try it in the press.

I guess Rush has been too effective in his opposition to the DNC.. Thats OK Rushie, we will fund your exodus to an off shore island if we have to, so you can continue broadcasting.

Keep fighting them Rush! Soon a suite of malicious prosecution will be brought by someone which will put several of the liberal prosecutors who think politically motivated prosecution is fair ball, right into th e poor house.

And the dems seek to paint your fine radio work as drug induced babble! They are scared to death of you!Lets hope they stay that way!
