(AP) -- Rush Limbaugh could see a deal with prosecutors in a long-running prescription fraud case collapse after authorities found a bottle of Viagra in his bag at Palm Beach International Airport. The prescription was not in his name. Limbaugh was detained for more than three hours Monday at the airport after returning from a vacation in the Dominican Republic. Customs officials found the Viagra in his luggage but his name was not on the prescription, said Paul Miller, a spokesman for the Palm Beach County Sheriff's Office. Miller said the alleged violation could be a second-degree misdemeanor. The sheriff's office was investigating and will soon turn the case over to the state attorney's office, which had no immediate comment Tuesday. Under the deal reached last month with prosecutors, Limbaugh was not to be arrested for any infraction for 18 months in exchange for authorities deferring a charge of ''doctor shopping.'' Prosecutors had alleged the conservative talk-show host illegally deceived multiple physicians to receive overlapping painkiller prescriptions. Limbaugh also must submit to random drug tests and continue treatment for his admitted addiction to painkillers. Limbaugh's doctor had prescribed the Viagra, but it was ''labeled as being issued to the physician rather than Mr. Limbaugh for privacy purposes,'' Roy Black, Limbaugh's attorney, said in a statement. U.S. Customs and Border Protection examined the 55-year-old radio commentator's luggage after his private plane landed at the airport, Miller said. Investigators confiscated the drugs, which treat erectile dysfunction. Limbaugh was released without being charged.

This point was discussed in an thread from earlier today.In short,there are a number of Federal laws (and,I suspect,state laws) that regulate the distribution of prescription medications...including ones that aren't addictive (that is,aren't "controlled substances").

No it is hysterical. This is going to be on the radio and get a ton of air play. Not only is Rush going to make the Florida DA out to be a fool, he is going to attack the NT Times for making this front page news and burying Iraq.
I'm sure there's a NYT subscriber somewhere whose dog does not know what viagra is for. The NYT is just making sure everybody understands.

He wasn't caught with anything. He had viagra, it was prefectly legal and they let him go after questioning. This was all put to rest last night but NYT is using it to smear Rush for those people, apparently you are one of them, who wish to believe the worst of a conservative, especially Rush.

The key to this whole thing is the leak to the press. Who did it? It wasn't wrong for them to hold him and resolve the prescription issue. But a phone call should have resolved it before anybody found out.
It's the Customs officials and/or the Palm Beach County Sheriff's office that ought to be in trouble here, for making this public. It's not clear that Rush committed any crime, nor has he been charged with committing any crime, and yet he's being put through public embarrassment with the story of what pills he's taking being broadcast around the globe.
Shouldn't both Customs officials and the Palm Beach County Sheriff's office have more pressing matters to attend to these days???? And why does anybody need a prescription for this stuff anyway? It's not an addictive narcotic, and has nowhere near the potential for harm that acetaminophen (e.g. Tylenol) has -- the latter being the leading cause of acute liver failure in the U.S.
