Mayor Won't Give Dead Marine's Money Back

The mother of a U.S. Marine was grieving for her dead son when she found that his savings account had been claimed by the director of the funeral home.

It was money that he had no right to and despite a court ruling, the funeral director refused to pay.

What's even more puzzling is that he's not just any debtor, he's the mayor of the small town and a member of a City Council that has financial responsibility for the city's budget.

7NEWS also found that he has other debts as well, something his constituents may want to know.

Jason Sepulveda, a Marine, was training at Camp Lejune in North Carolina, preparing to go to Iraq, when in an evening off-base, he was killed in a car accident.

Records show that the funeral was paid, in full, by the Marines.

But after closing out her son's accounts, Jason's mother realized that the probate court had sent the proceeds of Jason's savings account to the funeral home, which is run by Jim Bostick.

Sepulveda took Bostick to court ...

The judge's order ...gave damages, interests, court fines, everything...

But despite the judgment of more than $7,500, Bostick has refused to pay.

Court records show Bostick has several current unsatisfied debts to creditors from Greeley to Montana and that doesn't include money he owed when he filed bankruptcy in 2001.

"My son was in the Marines and he went there to do what was right for his country.

I know for a fact that for somebody to actually steal from him is not right," ...

"I feel like me, as a mother, I need to do this.

This was my son's money and I'm not going to go away."

I emailed this article to Orielly. Whatever you think of the guy, he will do a number on this Mayor if he decides to pursue it.

Question, Have you ever heard of a real incident of Dungaree Liberty or was it just Sea Lawyer talk? A Skipper could never get away with authorizing these days...

It looks to me that the family sued the wrong person in the wrong court. I wonder why.

Yep, exactly. I worked in lending/collections for a few years. All a judgement is is a judge offically declaring that somebody indeed owes money to somebody else.

After that, you're completely on your own collecting it. Even if you get a garnishment on a bank account or a lien on a piece of property, it can sometimes be very tricky actually getting the money you are owed. What if that judge has a bank account in some obscure local bank in South Carolina? There can be a lot of investigation work involved in collecting money. It's called "skip tracing." And it can be very FUN, too !

There are several odd things with this story...which simply don't add up. Normally, a court would require contacting the next of kin...when the whole thing came up in the first place...yet it appears the local court never said a word. As for the Marines...they would go precisely by their rules...which the locals ought to know very well....when a military guy dies...an official is appointed to handle personal effects and ownership of items on the post. If the credit companies presented evidence to this guy...and the Marines agreed...then they would pay off the debts as necessary. But still a next-of-kin would have been called before they went final...to give them a say. And normally...the Marines don't touch the bank accounts.

As for the mayor here...he may well be owed the money and can't understand why so many folks are arguing about this. Remember...alot of our GI's...are stupid at finances and get themselves in huge debt. I knew a 10-year GI...very professional individual...who had varous non-home loans equaling well over $80k. His entire paycheck went to pay loans. This guy may have been just as bad. I'd like to hear more information before I pass judgement.

Very strange. Why isn't he facing fraud, embezzlement or theft charges? Shouldn't the FBI be investigating this for a possible corruption angle?

You are so correct - it would be all over the front pages and the first report on the MSM. BUT, as we know, a Republican would never, ever do something like this.

The article mentioned Probate, which indicates the Marine didn't have a will. The benefits from the Marine Corps is a seperate issue from the legal disposition of his estate. It's a civilian legal matter.

You're right though, how this weasel was able to get a judgement against the estate without his family being notified stinks to high heaven! There should be an investigation into this.

i have seen you post about your past association in the Corps. i had very few dealings with Marines myself, (five years Regular Army), but figured you could speak of the behaviour of your bretheren who happen to be Force Recon.

There was a similar incident that i read about in a book written by Lt.Col. Steven Yedinak 5th Special Forces Group (Abn) retired.

Yedinak relates how as a Captain he was detailed to inform a woman that her son had been killed in Vietnam. He met the woman at the office she worked at and asked her supervisor to allow him the use of the office. The Supervisor, Capt. Yedinak, and the woman were in the office when he informed her that her (only) son had been KIA. The Supervisior immediately began to berate the military, and blamed the army for murdering the son, yadayadayada...

Yedinak calmly asked to speak alone with the supervisor, and told him the following "What you have just done in the presense of this woman, your employee, is shameful, disgraceful, and disrespectful of the memory of her only child. If I hear that you have spoken to her of this matter ever again, I will return to this place, not in uniform, and break your f**king neck. Any questions?"

Now a days, a Soldier, Sailor, Marine, or Airman would be court martialed for such behaviour. It's a disgrace what Political correctness has done to emasculate the finest fighting force this planet has ever seen.

That said, rather than a generic ass kicking, i think i'd prefer and/or impliment something FAR more painful on this piece of $#!t...skinning knives and rubbing alcohol comes to mind. Probably start with the fingers and toes...

Let's assume the following The Marine had at least $7500 saved up in saving/bank accounts.

Why? because the Mayor helped himself to the Marine's money, and the courts are demanding the Mayor pay it to the Marine's family but how is perhaps more important.

How could the Mayor has pilfered it, well he is the funeral director for one thing, so he knows who his clients are and despite the fact that the Marines paid for the funeral, I'd bet he had some sort of form that allows him to recoup funds for the services from the deceased moneys to pay for expenses legally.

Only he used that form illegally to empty out The Marine's bank account and perhaps for the first time got caught doing it.

Jason Sepulveda even in death may have done his community and his country one last service by exposing the illegal acts of a man that preyed on the dead, and robbed their families of the money they left behind,because as we all know criminals usually get caught after they've done their crimes repeatably .

My feeling exactly - I can't find any reference to whether he is Democrat or Republican but the smart money says that, if the press isn't having a field day with this story, that he is a Dem.
