DURHAM, N.C., April 19 The lawyer for a Duke University lacrosse player charged with raping a woman at a team party said he had "irrefutable, independent evidence" that the player was not there when the woman says the rape occurred.
The proof includes cellphone records, a taxi driver's account, an A.T.M. record and a time-coded dormitory entry card, J. Kirk Osborn, the lawyer for the player, Reade Seligmann, said in an interview.
Mr. Osborn, based in Chapel Hill, N.C., said Michael B. Nifong, the Durham County district attorney, had refused to meet with him. Mr. Nifong continued to decline to answer questions from reporters Wednesday as he awaited new DNA results. Mr. Nifong said in a statement Tuesday that he was trying to develop conclusive evidence on a third suspect.

Unfortunately for him innocence doesn't matter. They need a white boy thrown into the fire to appease the blacks.
The bad news here is that his initial call to the taxi driver was at 12:14am (according to the interview Rita Cosby *shudder* did with the cab driver this evening). The latest picture of the woman in the act of "dancing" was at 12:03am. That leaves eleven minutes, in which the accused could have initially participated in an assault (assuming one existed).

Well, there you go - he proved himself innocent - which is the proper legal standard in US courts for a man who is accused by a woman.
"The woman was hired as a stripper."(?) And the players were picked up by a man in a yellow car "hired as a taxi driver." And the woman called 911 and spoke to someone "hired as an emergency operator." And last I heard there were a bunch of dudes in blue uniforms riding around in black-and-white cars "hired as police officers."
Facts, facts, facts. You're messing up a good theory on support an important "news" story and you are doing it with facts. It's not fair, just not fair.
These defense attorneys are the most aggressive that I can recall. They are in the news cycle every day with more exculpatory material. God help any prosecutor that runs afoul of this bunch.
Usually the defense seems to stick to generalities and vague assertions of their clients innocence. I guess lawyers prefer not to irritate the prosecutor any more than they have to. In this case they are all over the guy.
If these guys are innocent or at least arguably "not guilty" I think this is the best job of defense I have ever seen-- assuming of course that a more diplomatic attorney couldn't have kept the guys from being charged in the first place.
This DA needs to be shredded and composted by the defense attorneys and this black crap is way overdone. Is there a charge or at least ethics violation to false prosecution where the guilty innocent are actually innocent.

Our local news seems to think he is sure to win. I have faith in the good people of Durham.
Actually, it was 12:03 and 57 seconds...so essentially 12:04. One minute counts here, since we're talking in terms of minutes..
That would leave 10 minutes for him to participate along with 3 other men in assaulting her in every orifice possible. (per her story).
If there was such a struggle before/during the act, as she claims, there wouldn't be time for the act to occur as she described in 10 minutes.
These guys are incredulous over the accusations and ridiculous arrests. They know they are innocent. They act innocent. The case and the media are a disgrace.
If he wins, the feds need to take over the district on civil rights grounds. His position is ridiculous.
"Affirmative Fiction" update/bump...
That'll be the day. "All proper procedures were followed." "The prosecution proceded in good faith." "We have the highest regard for the presumption of innocence." That's what you'll hear for about 1/2 a day when this is all over. Then nothing.
