Police: Duke accuser 'passed-out drunk'
Associated Press ^ | 4/13/2006 | AP

DURHAM, N.C. -- A woman who claims she was sexually assaulted by members of Duke University's lacrosse team was described as "just passed-out drunk" by one of the first police officers to see her, according to a recording of radio traffic released by Durham police on Thursday and obtained by The Associated Press.

The conversation between the officer and a police dispatcher took place about 1:30 a.m. March 14, about five minutes after a grocery store security guard called 911 to report a woman in the parking lot who would not get out of someone else's car.

The officer gave the dispatcher the police code for an intoxicated person and said the woman was unconscious. When asked whether she needed medical help, the officer said: "She's breathing and appears to be fine. She's not in distress. She's just passed-out drunk."

The black woman, a 27-year-old dancer and college student, told police she was sexually assaulted and beaten by three white men around midnight at an off-campus party thrown by Duke's lacrosse team. The racially charged allegations have led Duke to cancel the highly ranked team's season and accept the resignation of its coach.

No charges have been filed, but district attorney Mike Nifong has said he believes a crime was committed. Attorneys for the players have said DNA tests failed to connect any players to the alleged attack, and they have urged Nifong to drop his investigation.

The radio recordings, obtained by the AP through a records request, are the first instance in which police or anyone connected with the investigation has said the woman appeared to be intoxicated.

Defense lawyers, however, have said time-stamped photographs taken by the players show that the accuser was drunk and had already suffered some injuries when she arrived at the house for the party.

The recording is consistent with "what I have seen of the photo evidence before," attorney Kerry Sutton said. Those photos, she said, showed that she was "way beyond where you would put somebody behind the wheel of a car."

The description of the woman's medical exam -- which Nifong has said is his basis for believing a rape occurred -- does not mention her being drunk. It states only that the woman's injuries and behavior were consistent with having been raped, sexually assaulted and having suffered a traumatic experience.

The woman has told police she and another dancer hired to dance at the party arrived at 11:30 p.m. March 13. The pair reportedly left the house a short time later, fearing for their safety. The accuser told police the two were coaxed back into the house with an apology, at which point they were separated. That's when she said she was dragged into a bathroom and sexually assaulted, beaten and choked for a half-hour.

At 12:53 a.m., police received a 911 call from a woman complaining that she had been called racial slurs by white men gathered outside the home where the party took place.

The defense has said it believes the second dancer at the party made that call. The 911 call from the grocery store security guard was placed at 1:22 a.m.

In it, the caller says, "Um, the problem is ... it's a lady in somebody else's car and she will not get out of their car. She's like, she's like intoxicated, drunk or something. She's, I mean, she won't get out of the car, period."

A police spokeswoman did not immediately return a call seeking comment on the radio traffic.

The case has focused intense national scrutiny on Duke and the lacrosse players and has sparked protests on the elite private university's campus and elsewhere in Durham. The school last week canceled the highly ranked team's season and coach Mike Pressler resigned after the release of a vulgar and graphic e-mail sent by a team member shortly after the alleged assault.

Several of the defense attorneys say they expect the district attorney to ask a grand jury on Monday to issue charges in connection with allegations.

"Rest up on Sunday," Sutton said.

There has been no official word, however, on whether Nifong intends to present the allegations Monday. His next opportunity would come two weeks later.

I'm not all that troubled by that gap in time, just IMO.

The crack whore was scr****g her brains out all day long in the hood.

Remember, the test results showed no evidence of her having sex within several weeks of the incident. If anything, it appears she was spending the previous hours getting extremely drunk and/or high. With her being so intoxicated, and no physical evidence, there is no chance of a conviction under reasonable circumstances. If this were a normal situation, with no racial or other complications, the DA would have ended the investigation long ago.

How can that be?

I'm a little confused on that point, and maybe it's just been misreported in the press.

Surely there must have been SOME foreign DNA recovered from her in the hospital examination.

Otherwise, what DNA are they comparing the 46 samples to?

Not nearly as confused as the DA. This is exactly why I would not have submitted to a DNA test. I would have told the DA to test the stripper first. If there was no DNA evidence, there is no sense in testing me.

Maybe she was raped before she wasn't raped.

I thought I'd read they were from two different escort services, but that doesn't mean they don't have the same pimp. Some of those guys operate more than one agncy.

I don't think Kim wanted to be involved with Mangum, but maybe she has enough of a conscience that she didn't want to just leave her there in that kind of condition either.

Something occurred to me - I wonder if Nifong has looked at Mangum's cell phone activity during the time period she was supposedly being raped? If she was trying to call her pimp/BF during the time she was supposedly being raped, Nifong is going to have one of those big, "Whoops!" moments coming to him, lol!

Yes, that would be less likely, of course. But I thought they roused her from the lawn and sort of shuffled her over to the car, not actually carried her. Maybe she rallied for a few minutes?

But another thing I've wondered about, and that's this: Whatever she was on had to have been ingested shortly before she got to the house, because she was moving on her own steam when she got there. Who was she with? Who drove her there? That's who knows the truth, and if it's her BF/pimp (if they're one and the same, which I think is the case), the cops need to sweat him DRY, and they can if they have anything on him.

I think the first motion will be a motion to dismiss based on the identification, not just to quash the identification. If that fails, then they can move to exclude it.

"And I'd be really interested in hearing how he plans to explain how a woman who was dead drunk at 1:22 a.m. on March 14th can remember who did ANYTHING to her 45 minutes before that."

He can't explain. Nifong has so much rehabilitation of this "witness" before the case even starts, the hope that it doesn't start at all isn't unrealistic. The only problem I see with the case being thrown out for the identification is that it doesn't fully clear their names. That takes absolute proof that she's lying.

Do you really think it is probable, or even plausible, that three guys, all under the influence, within the close confines of a bathroom, vaginally, anally, and ORALLY raped AND beat a woman without leaving a single trace of DNA in or on her?

The pundits all like to talk about them maybe using condoms, maybe using a broom on her (ridiculous), and suggest that explains the lack of DNA, yet holler about how drunk they were, how much they drink, and how arrogant they are. No. One of them would have left SOMETHING in or on here somewhere.

They cannot tell that from a medical exam. I don't know where that came from, but they can't tell that from a rape exam. SHE may have told them that, but that is not the same thing as a medical conclusion, lol.

Looks like she's got an alias of McNeil. That was probably her married name, but it could be the other way around.

The photos show the accuser sprawled on the ground, passed out just before 12:41. ....Someone physically has to help her into the car at 12:41..... The cop says she is unconscious at 1:30...... The security guard may be saying the same thing at 1:22. ..... So is there any reason to think she sobered up for a few minutes and passed out again, or was she more likely passed out or unresponsive the whole time?

Hmmm. Someone just may have been trying to "coax" her to awaken for about 45 minutes or so.

Question:

Her fee was $800.00? I wonder how much of that she gets to keep and how much the "escort" service gets?

Perception was a bunch of rich, white boys. Lotsa dollar bills--no make that 10 dollar bills. Good tips.

Maybe tips sucked and they were in the bathroom bitchin' about how those white boys ripped them off. "If we were white, they'd throw the money at us." That is when a plan was born-not a very well thought out plan. But working in their favor was an idiot DA.
