Secretary of state calls for her resignation Tuesday, March 07, 2006 By Brian Thevenot Staff writer Criminal District Court Clerk Kimberly Williamson Butler, who spent last week ignoring court orders and dodging arrest warrants, was led away from a courtroom to a jail cell on Monday after she refused to admit breaking the law before a panel of increasingly irritated judges. Advertisement Just hours later, Secretary of State Al Ater, Louisiana's top election official, called for Butler's resignation and vowed to explore every option to keep her from managing the April 22 election. Butler landed in jail after nine of the city's 13 criminal district judges sentenced her to three days in Orleans Parish Prison without bail and ordered her to pay a $500 fine on contempt of court charges. They charged that she failed to comply with their order last month to turn over management of her office's stalled applications for FEMA funds. The sentence came a little more than a week after Butler began a standoff with the judges, going into hiding to avoid arrest and arguing that their order was an illegal infringement on the authority of her office. When she reappeared Friday, she announced she would not seek re-election as clerk and run for mayor instead. In court Monday, Butler said she would serve out the remainder of her term as clerk and thus manage the April election. But a fed-up Ater called for her to quit now. Breaking months of silence on Monday, Ater called for Butler's resignation and branded her most recent behavior a "disgrace." "I've never worked with a more unprofessional person," Ater said. "I want her out of the way, and I'm exploring every option I can. . . .

On Monday, Butler again told judges that their order was illegal and said she had not violated the law. Johnson said without Butler acknowledging breaking the law and showing contrition, they found no reason to spare her jail.
"Without question, the whole thing would have been different," he said. "I tried to tell her that."
After the sentencing, Carter told the court that Butler would now sign "whatever is necessary" to comply with the original court order and stay out of prison.
Too late, the judges told Butler.
"You can still obey the order," Johnson said, "which is what you should have done last week, what you should have done when you walked in here Friday, and what you should have done when you walked in here this morning."
