One of the more ridiculous episodes of political theater is about to play itself out on the Senate floor, as the John Kerry-led democrats mount an exercise in political futility which will further expose their total irrelevance..So join us today, or drop in on occasion, for the festivities...

Can anyone provide a brief summary of what's going on? are some of the votes for Alito disappearing? Is there a website I can follow this on other than this thread?

Several FReepers have asked whether Senator Ensign could vote by proxy on the cloture motion. As I understand Senate rules, the answer is NO.

There is the old Senatorial courtesy known as the pairing of votes. It is possible that vote pairing could come into play on the actual vote to confirm Judge Alito, should Senator Ensign be unable to get to the Senate floor. Senator Ensign, an Alito supporter, could contact an Alito opponent with whom he (Ensign) is on good terms. That Senator would abstain, and have his vote listed as "Paired Against," while Ensign would be listed as "Paired For."

This doesn't work, however, on a cloture vote. Sixty votes (not just 60% of those attending) are needed to shut off debate. So an abstention is functionally the same as a vote against shutting off debate. Therefore, there's nothing to "pair."

Oh, I just had a thought. If the sillybuster DOES happen, the Republicans can't/shouldn't pull the trigger on the constitutional option today, because they will need Ensign's vote on the question of using the fillibutster on judicial nominees. If there are only 99 senators available to vote, Cheney wouldn't be needed to 'break a tie'. The Republicans may have to wait until tomorrow to put the rule to the chair, assuming Ensign will be there by then.

As much as I have been following this whole Alito debate, the Republicans are following protocol.
