Kennedy is the going to be the killer on that court.
I hate to say it but he is even worse than O'Connor.
Kennedy has moved even farther left in recent years.
Reagan should have picked another conservative after bork instead of picking that liberal kennedy from the 9th circuit.
Didn't even have to be someone as great as bork. Just a conservative.

this is a matter for the statesOk, state law trumps federal law if it is to kill human life, but state law does NOT trump federal law if it is to save human life.
Man, O man.

So does this mean attempted suicide would no longer be against the law? Obviously if someone actually commits suicide, it would be a moot point.

That sums it up: the more disposable human life can become, the more liberals/Democrats celebrate. They must be partying big time at DNC.

If Stevens and Ginsberg would resign in the next couple of months, it wouldn't really matter if Kennedy became a member of the Communist party. The amount of damage he could do would be severely limited.

Even had Alito been seated, the decision would have been the same, but 5-4.

I do question where the federal government has authority in this area. I'll be interested in reading the dissent, as Justice Thomas especially is usually suspicious of vague claims of federal authority.
This is a horrible law, but I have long thought the way to overturn it is to take it to the voters again after a lengthy period of voter education.

The God-given, unalienable right to life is dead in America. The horrors to follow will not be pretty...
You are so right EV! Sad day for America.

Seems like the supreme court is moving quick with these cases with o'connor still there.
Most legal experts thought the decision would come down next month.
The court heard parental notification on november 30. Now the dems want to delay on that as well.
O'Connor will be the 5th vote for the dems in that case.
Specter is a fool for not having the hearings start right after new year's.

The patient only. Then it must be "approved" by 2 doctors who testify that the patient has a terminal disease, has less than 6 months to live and is in sound mind to make the decision.

Constitutional law seems to be crumbling. I was sure this would not be upheld.

yep, they already kill most babies in the womb and sick people in commas, now they will start killing the sick people who are depressed because their relatives don't want to pay for them anymore, next it will be anyone older than a certain age, and followed soon after by anyone with a disability.
funny how we are starting to look as bad as the nazi's we defeated.

he's no fool, the RINO Specter is pro-death, he knows exactly what he is doing.
why in heck does the republican party allow rino's to sit on the judiciary committee !?!
To: SoFloFreeper
Justice Anthony Kennedy, writing for the majority, said the federal government does, indeed, have the authority to go after drug dealers and pass rules for health and safety. But Oregon's law covers only extremely sick people -- those with incurable diseases, whom at least two doctors agree have six months or less to live and are of sound mind. Crazy subjective double standard inconsistent reasoning and criteria for this murder.
Worst possible opinion.
It's OK to murder -- even though technically the US government can stop it legally -- but "experts" say it is OK -- two of them.
Recipe for disaster.

The real legal issue here is not assisted suicide, but the power of the federal government over the sovereignty of the states. Kennedy just had a conservative moment and sided with the states.

Roberts and Justices Clarence Thomas and Antonin Scalia dissented. G-d bless them, and G-d save us!
