Day 4: Hearing Resumes
This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

Alito is giving another very thoughtful response to the question about how O'Connor should be remembered.
Part of me thinks he's the most thoughtful guy in America. He clearly is the most thoughtful judge I've ever seen.

Alito: If the founders had wanted judges to make decisions based on public opinion, they would have made them elected. But lots of decisions lie in the political branches so people can have control over their destinies. Soveriegnty lies in the people. Decisions are supposed to lie in the political branches, but are decided by the courts when (1) the political branches are too cowardly to decide the issue, (2) advocates can't convince the political branches to decide their way so they find sympathetic judges to implement their desires, or (3) overreaching judges unilaterally impose decisions, ignoring the political branches.

The sickest thing is that most of these so called teachers are so pathetic about the issues. My days among the "scholarly" professors at Universty of Mich. left with perplexing questions about how they could have such "goregasms".
This was during the time of pregnant or hanging chads and those highly educated fools were wringing their hands and panicing-a very sad time indeed. Embarrassing to watch these foolish liberals.

Even the usual knee-jerk liberal commentators are making fun of it. They got nothing on him..nothing.We found that out this morning. Kennedy's staffers hit a brick wall at 2:00 this morning over these Rusher Papers and C.A.P. nonsense. I bet they were really thrilled with the boss over that one.
Kennedy looked like he needed some heartburn medication this morning. I suspect a few staffers probably punched him in the gut this morning.
