Day 4: Hearing Resumes
This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

Somebody ought to let the Republicans on the panel know about Justice O'Connor's stance in that particular case. It was early in her tenure on the court and apparently, like others, her judicial mindset changed over time, but her opinion and Judge Alito's opinion were the same for that period in 1985 and their opinion reflected much of what many state laws said on the matter.
I'm sure the Oriental professor knew of Justice O'Connor's dissenting opinion in Tennessee v Garner and it's amazing that he was able to cite the Alito memo on the matter with a straight face.
