Day 4: Hearing Resumes
This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

4:55: Sessions points out that Congress messed up Rybar, not Alito. Laughter (agreement?) in the room. Sessions is asking whether or not throwing rocks at people is a federal crime.
4:53: Senator Sessions remarks that Alito's civil rights opinions have almost always been unanimous.
4:53: Senator Durbin is up and agrees with Senator Leahy on the inappropriateness of questioning sitting judges. Senator DeWine has no questions for the panel.
4:50: Senator Kyl is asking for clarification on the 3rd Circuit's policy of distributing 3-judge panel opinions to the whole court. Not every Circuit does this.
Judge Scirica is clarifying. They only circulate precedential opinions, or non-precedential opinions with a dissent. Therefore precedential opinions are sent to the court twice - before and after publication.
Kyl is asking what happens if a Judge disagrees on the initial circulation. The Judge can write to the opinion writer or the entire court expressing his/her disagreement.
4:47: Senator Leahy is up. Senator Leahy points out that Alito will have to rule on the decisions of some of the current judges on the panel. Rather than create a difficult for the judges if Alito is confirmed he is not going to avail himself of the chance to ask questions of the panel.
I,m sorry, Sessions is making that point.
I would say that I would love for Roe v. Wade to be overturned. I think it was unconstitutional and should never have existed. But I don't know what your point is. If the constitution is applied, this will come to be overturned at some point. And I'm sure that Judge Alito will base his decisions on the law and the constitution.
This past July my youngest granddaughter was born.. stillborn. When I was trying to help them with her funeral arrangements I talked to a funeral director back home that called my sweet granddaughter a FETUS. She wasn't a FETUS to me, she was a baby, a girl baby, my granddaughter, she has a name. This abortion thing is really bothering me and I am sick to death of hearing about a "womans right to choose" and "reproductive rights" from DiFi and Schumer and Kennedy, etc.

no reason they could not appear. the only reason the dems are squawking about this UNPRECEDENTED panel, is that they weren't the ones able to put one together for one of their candidates first. xshub says arlen has performed admirably in organizing this, and he is NOT an arlen fan.
I am embarrassed that so many Senators could not take time out of their busy (?) schedule to listen to these men and women who traveled to support their colleague.
Disgraceful conduct on the part of nearly all of them.
Leahy's refusal to ask questions of the judges strikes me similarly.
These strike me as the wailing of spoiled little brats who got picked to be on the losing team in a neighborhood scratch baseball game. Since they lost, they're picking up their bats and balls and going home.
Leahy said something about them not being able to tell the truth though!
one of the biggest mysteries in life is how that bloated sot hasn't stroked out to date.
Cornyn just slammed Leahy and Durbin.

Also keep in mind we have tons of cases by Alito on the record.
If there was any doubt as to his strict constructionist, conservative credentials, you should have no doubt alarm bells would be going off at FR and at NR etc.
This guy is a conservative. Some liberals like the guy.
People can like people they disagree with. I like several liberals even though I think they are flat wrong.

Cornyn is reading them the riot act about implying impropriety on the part of the judges for testifying.
And it was a BEAUTIFUL thing! Thank you Sen. Cornyn!
Judge Gibbons said it. He doesn't like Bush either which makes that statement even better.
