Day 4: Hearing Resumes
This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

Byron York had an article in National Review once that said Leahy was the most hated and hateful man in the Senate. Hard to believe, isn't it, when he has so much competition for the title?

Specter was trying to get time limits, and suggested that nobody should need more than 25 minutes. Leahy said that was probably OK, but he was concerned that something might come up, something exceptional, that might require more time, and he didn't want to consent to a limit and be stopped from getting more time later.
It appeared to me that Specter was both being magnanimous, but also tweaking Leahy, when he referred to that several times as the "Leahy exceptional circumstance standard". I believe the consent agreement was that if someone wanted more time, Specter would leave it up to Leahy to determine if the circumstance warrented the extra time.
It was an example of possibly misplaced comity and trust, but it is how the senate should operate. There was a time that Senators really took their jobs seriously, and didn't treat it as a big political game. At least I like to pretend there was such a time.
That was one of the interesting things about the movie "Mr Smith Goes to Washington". They never showed any indication of senators acting on a party-line basis.

Why are they asking Alito's PERSONAL view on Schiavo, RoeVWade, etc? A Judge judges based on law. The SCOTUS ruled on these; Alito is not yet a Supreme Court justice.
The reason they ask is because they want people to do as they do; use personal agendas to dictate choices.
What do cats do once they catch the mouse?
That's sometimes the downside. If your cat really loves you, it will leave the mouse in a special place for you as a gift. Beside the pillow or in a shoe, for example.
When he leans over to Arlen I worry that he is trying to share his illness.
I doubt this discussion will get to the flaw in the legal system or process that I see in the Schiavo line, but no matter for these hearings.

Leahy is on the worst fishing trip since "The Perfect Storm".
He would have been the best Chief Justice.
However, fate intervened in the process and we are lucky to have him on the Court as an associate Justice.
No offense intended, but can we quit with the mouse convo? I'm trying to follow the hearing.

Too late now, but if I had seen that yesterday I would have suggested the following:
"How do you keep from getting out of your chair, coming over here, and punching me, Judge Alito? Are you afraid you would loose your hand in my formidably boulbous body, or do you fear 2nd-hand alchohol poisoning?"
