WASHINGTON, Dec. 23 - The National Security Agency has traced and analyzed large volumes of telephone and Internet communications flowing into and out of the United States as part of the eavesdropping program that President Bush approved after the Sept. 11, 2001, attacks to hunt for evidence of terrorist activity, according to current and former government officials.
The volume of information harvested from telecommunication data and voice networks, without court-approved warrants, is much larger than the White House has acknowledged, the officials said. It was collected by tapping directly into some of the American telecommunication system's main arteries, they said.

Surly releasing details of the NSA program is the release of more SECRETs - why is there no stopping this? Where is the DOJ/FBI? Why aren't folk at the NYT being marched out to jail awaiting their duly appointed ACLU lawyers?

Well if the classified program has been released public then its not illegal of course; but if it is still classified and not released, then I think it is considered a crime.

Let me be more specific. The publishing of classified information by recognised media is not illegal. Giving classified materiel to the meida most certainly is illegal.

Washington, DC, January 28, 2004 Earlier today, Citizens for Responsibility and Ethics in Washington, a non-profit legal watchdog group, sent a letter to President Bush asking that he call upon the White House Counsel to investigate Vice President Cheney's confirmation of leaked classified information in an interview with the Rocky Mountain News on January 9, 2004.
Federal law prohibits leaking classified information. Confirming information that has already been leaked is also prohibited. In his Jan.9th interview, Mr. Cheney referred his interviewer to a story that appeared in The Weekly Standard's November 24, 2003 issue. The story, written by Stephen F. Hayes, discussed a 16 page memo written by Defense Department Under Secretary for Policy regarding raw data and reports describing possible links between Al Queda and Iraq.

Because the handcuffs would come from exercising the War Power of the United States, and Congress has not acted to permit that.
There is much, much more to a state of war than the President and SECDEF moving troops around and having them kill people and break things.
This is an example of clear, unambiguous language which would permit (DID, in fact, permit) full press censorship:
"the President is hereby authorized and directed to employ the entire naval and military forces of the United States and the resources of the Government to carry on war against the Imperial Government of Japan; and, to bring the conflict to a successful termination, all of the resources of the country are hereby pledged by the Congress of the United States."
If they didn't do this stuff they should rot in dank prison.

The NYT was probably happy that we didn't share the info that those new fangled radars picked up at Pearl Harbor the morning of December 7th, 1941.
It would have violated the Japenese pilot's right to privacy to fly over international waters.
