I think that is why I have been posting about this...

I don't think Turley has the reputation of just shooting totally from the left...but, hopefully that is what he is doing..

The ONE thing I keep reminding myself (in order to make myself feel better)...is that if Graham, Rockefeller, and others knew about this...BUT, said nothing..or did nothing to leak this during Bush's campaign last year...

then, they must have KNOWN...that there were nothing there to "get Bush" with...I mean they are still talking about the Texas National Guard stuff...so I can't imagine that they wouldn't have found some way to use this against Bush..

to impeach they would have to get a majority in the House, and that won't happen.

I have to tell you what I heard Feinstein say on Hardball tonight. She said that the country doesn't have checks and balances when the House, Senate and Presidency are held by the same political party. That's her definition of our system of checks and balances.

That's what I'm thinking also.....but we know the rats and the MSM will run with this to try to sway public opinion that Bush committed a crime and call for his impeachment.....Gawd, I hate these rats with a passion.....

They are still hurting over the impeachment of that criminal in office in the 90's. Besides, their party is dead and if somethin' major is not accomplished soon...by the dead party...they'll be announcing when their funeral is sooner than later.

In time, Congress grew concerned about the FBI's power, and after Prohibition's repeal it outlawed all non-consensual wiretapping (but not bugging) as part of the 1934 Communications Act. In 1939, the Supreme Court upheld that law, ruling that since taps were illegal, evidence obtained from using them was inadmissible in court.

Even so, executive officials kept using wiretaps. In particular, Franklin Roosevelt sought to carve out a large exception to the statutory ban. In 1940, he wrote his attorney general, Robert Jackson, that while he accepted the court rulings that upheld the 1934 law, he didn't think those prohibitions applied to "grave matters involving the defense of the nation"—an increasingly high priority as world war loomed. On the contrary, Roosevelt ordered Jackson to proceed with the secret use of "listening devices" (taps or bugs) to monitor "persons suspected of subversive activities … including suspected spies."

Concerned about a German "fifth column" in the United States, Roosevelt specified that his order applied to espionage by foreign agents. But when Harry Truman succeeded FDR in 1945, America's enemies list was changing fast. The next year, as the Iron Curtain fell and the Red Scare flared, Truman's attorney general, Tom Clark, expanded FDR's national security order to permit the surveillance of "domestic subversives." Clark and Truman endorsed wiretapping whenever matters of "domestic security" were at stake, allowing taps to be placed on someone simply because he held radical views.

Very good find. It's starting to sound like every president in my lifetime (and before) was using warrantless wiretaps.

Carter used them too.

It will be okay, mystery. The president consulted with the Attorney General and Congress. I don't believe he broke the law

Turley is basing this on the fact that Congress didn't "officially" declare war

However .. Congress did give the President the authority to fight this war ... with over sight

Which the President did do .. he took it to the AG, FISA .... AND to Congress Leadership and briefed them all

Echelon, the National Security Agency's shadowy data collection system operated in conjunction with friendly nations, could be used against Americans. Information gathered from Echelon and other electronic surveillance by foreign governments could be used against Americans "even if the collection would have violated the Fourth Amendment," according to the Justice Department's analysis of MATA.


That was passed by the House and included in the Patriot Act.

But the difference with RFK and Bush is .. Bush did it to track down terrorist .. Bobby Kennedy didn't to protect his brother ... and party

Bobby Kennedy wiretapped Martin Luther King for crying out loud. Can you imagine if a Republican had done that? The leftists are such hypocrites.

Let's just hope the conservative reporters and Republican congresscritters keep researching and put the pressure on the left for their blatant hypocrisy and lies.

You know, Mo1, that legislation that I mentioned is in the Patriot Act. It occurs to me there are two reasons why the left so desperately wants that Act to go away.

1) So they can press forward with impeachment hearings with the hope the public will not understand that THEY gave the president the authority to use warrantless wiretaps against US citizens with connections to AQ.

2) Because those wiretaps were coming too close to finding out the shady relationships that some of them have with Arabs and possibly jihadists.

O'Reilly, Turley and the other lawyer ALL said hearings should happen AGAINST Bush...NOT to find out the leaker

I didn't see the show .. But I am listening to BOR on the radio

He is fully behind the president in what the President did as long as it is to fight the terrorists

But you are correct .. he is not interested in who leaked the information

He also thinks the NYT set the President up after sitting on this news for over a year
