U.S. Judge Demands More for Arizona Students (orders increased spending on non-English speakers)

A federal judge Friday ordered the Legislature to spend more money on education for students learning English and said he will impose fines starting at $500,000 a day late next month if deadlines aren't met.

U.S. District Judge Raner C. Collins also ruled that the estimated 160,000 Arizona students learning English will be able to get high school diplomas without passing the state's graduation test until they've had time to prepare in adequately funded programs.

Plaintiffs claim the state's AIMS test is unfair to students learning English because of shortcomings in programs intended to improve their skills in the language. The state, however, said excluding them from the graduation requirement would be unfair to other students.

The AIMS test measures students' mastery of state curriculum standards in math, reading and writing. Beginning next spring, seniors must pass the test to graduate.

Collins ruled in a class-action lawsuit, originally filed in 1992 by two parents in the Nogales district, that seeks more state help for students with limited English skills.

Another judge in 2000 found state efforts lacking. Collins had previously ordered that improvements be made by the end of the last legislative session.

Democratic Gov. Janet Napolitano, disagreeing with the Republican-controlled Legislature over how to respond, vetoed legislation she called inadequate.

Collins ordered fines to start at $500,000 a day beginning Jan. 24 - about two weeks after the next regular legislative session begins - if lawmakers haven't fixed the programs. The fines would rise later, reaching $2 million a day if improvements aren't made by the end of the session.

the assumption here is that these students WANT to learn english..more and more, spanish is becoming the accepted language down there and there is no need to learn anything else..

Apparently this judge saw the Mass. Supreme Court get away with giving the legislature orders and decided that she could do it too.

The courts have hijacked the power of the purse from the legislatures; it's just a matter of time before they find a wat to get their hands on the sword.

Judges can't order legislatures to do anything. Why do these people put up with this crap from judges? Tell them to go to hell. There job is to rule on the constitutionallity of laws not impose fines and giver orders! Down with activist judges, kick the Dems out of the judicial!

I don't think they would like the outcome if they attempted to "take the sword". It'd get awful messy, really quickly.

Judge Raner Collins is acting like a dictator. Since when can judges award high school diplomas to students too stupid to graduated from high schools whose requirements are too low to begin with?

I know families with children who didn't speak English when they came to this country. They all learned quickly.

They can learn - if they want to. Lazy is the Mexican student - going like a fire ball is the Oriental student. AZ tax dollars spent on this is wasteful.

ENGLISH ONLY IF YOU WANT AN EDUCATION IN ARIZONA!

Agreed, this judge has no business being on the bench. And he isn't the only one setting himself/herself up as a dictators. Incredibly outlandish decisions have been made by scores of judges who are passing laws and making decisions on every aspect of our lives.

We are becoming a dictatorship of judges.

If the idea of the fines is to learn to speak english...to make things fair to those that cant speak english....Id impose a $500 a word fine if caught using any other language but our native tongue...Practice makes perfect!

Sure they can learn. But so many of these illegal aliens as well as many legal immigrants in our area have such a sense of entitlement, demand that we learn their language or provide them with translators.
