South Africa's High Court Rules in Favor of Gay Marriage
NY Times ^ | Nov 1 | MICHAEL WINES

South Africa's highest court ruled today that same-sex marriages enjoy the same legal status as those between men and women, effectively making the nation one of just five worldwide that have removed legal barriers to gay and lesbian unions. But the Constitutional Court, as the high court is known, effectively stayed its ruling for one year to give the Parliament time to amend a 1961 marriage law to reflect its decision. Should the legislature balk, the court said, the law will be automatically changed to make its provisions gender-neutral. Few expect the Parliament to resist, even though African nations are generally intolerant of gay relationships and many South Africans are conservative on social issues. Among political factions here, only the tiny African Christian Democratic Party, whose positions carry a strong religious undercurrent, called for a constitutional amendment to bar gay marriages.

I love this line.

This court is a liberal's dream. This is exactly what they wish they could create here in america. Where judges = legislators and legislators = elected figureheads.

This should help stem the tide of HIV in Africa.

Buzzy Ginsburg will be studying this ruling carefully.

Maybe the gays here in the united states should think about moving there.

"Buzzy Ginsburg will be studying this ruling carefully."

Preview of what we can expect from Hillary's nominees to the Supreme Court.

It's good to see how well South Africa is doing, now that blacks are in full control of their destiny...

That's okay with me, so long as they have full ownership of the consequences and don't look to evil white devils to bail their sorry asses out of their problems..

This is similar to the ultimatum given to the Massachusetts legislature by the Mass. Supreme Court.

And, not by accident, the woman who is currently "Chief Justice" of the MSC is the former South African lawyuh, Margaret Marshall .

So we can see where her notions of "constitutional government" come from, and note that they are totally inconsistent with the American Constitution, in that they amount to the Judiciary issuing ministerial orders to the legislature.

IOW, the inmates running the asylum.

Both Massachusetts and Vermont, as well as the Canada supreme courts, gave ultimata to the legislatures on this issue.

Maybe. Chief Justice of the Supreme Court of Massachusetts Margaret Marshall (the woman who gave us same-sex marriage) is from South Africa. I rather wish she had stayed there.
